O ESTADO DE COISAS INCONSTITUCIONAL DO SISTEMA CARCERÁRIO BRASILEIRO E A SISTÊMICA VIOLAÇÃO DOS DIREITOS FUNDAMENTAIS

Resumo: The Brazilian gaol system is one of the largest prisonals systems in the world. As indicated by the last official analysis made by INFOPEN (the official organ of Ministry of Justice that offers data from prisons in the country), the total number of people under the State custody was 726.712 (seven hundred and twenty six thousand, seven hundred and twelve), in June of 2016 (INFOPEN, jun. 2016). As stated, there is, at least, 726.712 (seven hundred and twenty six thousand, seven hundred and twelve) prisoners to 326.712 (three hundred and twenty-six thousand, seventy and twelve) available places on prisons. The deficiency of available space on prisons generates a degrading state to the inwards, which make them support a condition analogue to torture, that offers almost no chance to a future recuperation. The situation in which these people are uphold in Brazil leads the entire system to a state of unconstitutionality, that makes very clear the necessity to rearrange the system in the country. As it is, the prison apparatus does not show conditions to recuperate the prisoners.

Segundo a última estimativa disponibilizada pelo INFOPEN, o número de pessoas sob custódia do Estado era de 726.712 (setecentos e vinte e seis mil, setecentos e doze) em junho de 2016 (INFOPEN, jun. 2016). Segundo dados, há, no mínimo, 726.712 presos para 326.712 (trezentas e vinte e seis mil, setecentas e doze) vagas, o que nos leva ao déficit de 358.663 (trezentas e cinquenta e oito mil, seiscentas e sessenta e três) vagas (CNJ, 2016). A deficiência de vagas gera um estado degradante aos internos, fazendo-os suportar uma condição análoga à tortura, que pouca margem deixa para uma futura recuperação. A situação suportada pelos detentos no Brasil induz o sistema carcerário à um estado de inconstitucionalidade. Assim, torna-se expressa a necessidade da reavaliação das prisões vigentes no sistema.
