Ius Sive Potentia: Paulo e Spinoza

Esse artigo se integra em projeto de pesquisa intitulado Direito como potência, dedicado a investigar a relação entre Direito e ontologia às margens, mas também a partir das possibilidades abertas pela modernidade. Com Paulo podemos entender a possibilidade da justiça, no sentido de uma liberação geral do ser humano. A potência e o universal aparecem no sentido explícito. Ainda que a palavra esteja ausente, o universalismo vai pensado em Paulo e levado até suas consequências práticas. Em paralelo, temos em Spinoza uma possibilidade da confrontação com a teleologia moderna, em que suas consequências no direito, na política e na economia vão tematizadas e criticadas em suas fundações. No seu lugar, na articulação de uma outra modernidade, na qual o universal, talvez, só possa aparecer neste caminho da afirmação da diferença. Mas, o que se afirma é o nosso plano comum da imanência, a nossa igualdade.Palavras-chave: Paulo. Spinoza. Potência. Ontologia. Universalismo.Ius Sive Potentia: Paul and Spinoza ABSTRACT:This article is part of a research project entitled Law as potency, dedicated to the investigation of the relation between Law and ontology at the margins, but also from the possibilities opened by modernity. With Paul we can comprehend the possibility of justice, meaning with it a whole liberation of the human being. Potency and universality appears explicitly. Although the word is missing, universalism is thought in Paul and carried on to its practical consequences. At the same time, with Spinoza we have the possibility of a confrontation with modern teleology, in which its consequences to law, politics and economics are thematized and criticized in their foundation. In its place, we have an articulation of another modernity, in which, perhaps, the universal can appear in the way of the affirmation of difference. But, what is affirmed is the common dimension of immanence, our equality.Keywords: Paul. Spinoza. Potency. Ontology.
