THE RIGHT TO LEISURE AND SPORT ON THE AFRICAN CONTINENT: A LOOK AT THE NATIONAL CONSTITUTIONS

Resumo: The study is contextualized by the recognition of leisure and sport as social rights, fulfilling the objective of verifying the mention of leisure and sport as rights in the Constitutional Charters of the 54countries of the African continent, making non-hegemonic contexts visible, notified marked by colonial violence. For this, the Documentary Analysis of the national constitutions of the 54 countries of the continent was carried out, referenced by the terms "leisure", "sport" and "recreation". It was observed that 20 nations mention leisure as a social right, 22 do so in relation to sport, and 14 addresses both rights, and 27 do not mention leisure or sport. It is concluded that a significant portion of African countries recognize leisure and sport as social rights in their legal order, without this reflecting their effective presence in everyday social life, suggesting that new investigations in specific sociocultural contexts be carried out.

It is concluded that a significant portion of African countries recognize leisure and sport as social rights in their legal order, without this reflecting their effective presence in everyday social life, suggesting that new investigations in specific sociocultural contexts be carried out.El estudio se contextualiza con el reconocimiento del ocio y el deporte como derechos sociales, cumpliendo con el objetivo de verificar la mención del ocio y el deporte como derechos en las Cartas Constitucionales de los 54países del continente africano, haciendo visibles contextos no hegemónicos, marcados por la violencia colonial.  Para ello, se llevó a cabo el Análisis Documental de las constituciones nacionales de los 54 países del continente, referenciado por los términos "ocio", "deporte" y "recreación".  Se observó que 20 naciones mencionan el ocio como un derecho social, 22 lo hacen en relación con el deporte, y 14 abordan ambos derechos, y 27 no mencionan el ocio o el deporte.   Se concluye que una parte importante de los países africanos reconocen el ocio y el deporte como derechos sociales en su ordenamiento jurídico, sin que ello refleje su presencia efectiva en la vida social cotidiana, lo que sugiere que se lleven a cabo nuevas investigaciones en contextos socioculturales específicos.O estudo se contextualiza pelo reconhecimento do lazer e do esporte como direitos sociais, cumprindo o objetivo de verificar a menção ao lazer e ao esporte como direitos nas Cartas Constitucionais dos 54 países do continente africano, visibilizando contextos não hegemônicos, notadamente marcados pela violência colonial. Para isso foi realizada a Análise Documental das constituições nacionais dos 54 países do continente, referenciada pelos termos “leisure”, “sport” e “recreation”. Observou-se que 20 nações mencionam o lazer como direito social, 22 o fazem em relação ao esporte, sendo que 14 abordam ambos os direitos, e 27 não mencionam nem o lazer nem o esporte.
