SOCIAL CONTROL AND THE TERMINATION OF MANAGEMENT COUNCILS: IS IT POSSIBLE TO DEFINE A CONSENSUS FRAMEWORK IN THE LIGHT OF HABERMAS' LESSONS?

Resumo: | The article aims to identify and analyze the possible implications for the extent of social control, with the issuance of Decree No. 9,759/2019 – which extinguished the Management Councils at the federal level – using as a parameter Habermas' model of circulation of political power. The essay conducts a dialogue between the conceptions of democracy, circulation of power, public sphere and social control. The circulation of political power that occurs through language and communicative action moves from the center to the periphery or inverse. This model defines society's participation in the elaboration of laws and norms that guide its life in society, characterizing itself as an instrument of social control. It was possible to conclude that the Management Councils would be the locks through which the communicative action would take place, providing a flow of power. With its extinction, this flow suffered a strong shake, directly affecting the Democratic Rule of Law. |

O ensaio realiza um diálogo entre as concepções de democracia, circulação de poder, esfera pública e controle social. A circulação do poder político que ocorre por meio da linguagem e da ação comunicativa se movimenta do centro para a periferia ou o inverso. Este modelo define a participação da sociedade na elaboração de leis e normas que orientam a sua vida em sociedade, caracterizando-se como um instrumento de controle social. Foi possível concluir que os Conselhos Gestores seriam as eclusas por onde aconteceria a ação comunicativa, proporcionando um fluxo de poder.
