Kantian moral universalism: an ethical approach of human dignity in public international law

Resumo: | PROBLEM: The problematic of this article discusses how the proposal of Kant's universalist ethics can support the universal foundation of human dignity, focusing on Kantian philosophical theory, through the analysis of the work The Foundations of the Metaphysics of Morals. This article relates the Kantian philosophical conception with the issues of Public International Law of Human Rights. OBJECTIVES: The study aims to understand the necessity of a priori moral laws to constitute, through practical reason, the good will to act according to duty. The categorical imperative and the autonomy of the will of the universal legislator are conceptualized to identify the dignity of the human person, having man as an end in himself. It is shown that man is a possessor of duties (responsibilities)/rights (freedom-autonomy of will). Aspects of the ethical foundation of human dignity are identified in order to compare them with the current principles of public international law. METHODOLOGY: The research is qualitative bibliographical, focusing on Immanuel Kant's "Foundation of the Metaphysics of Morals", followed by the analysis of books and scientific articles on the subject. Following the doctrinal analysis, the subject is related to the exposition of the articles of international treaties of the human rights protection system. CONCLUSIONS: The research is justified on the basis of the universal ethical need to link national law with international law, independently of positivized international norms, according to contemporary requirements vis-à-vis all established powers, official or not. It is concluded that an international organization founded on principles based on universal morality is necessary for the protection of human dignity in order to achieve peace. |

Este artículo relaciona la concepción filosófica kantiana con las cuestiones de Derecho Internacional Público de los Derechos Humanos. OBJETIVOS: El estudio pretende comprender la necesidad de las leyes morales a priori para constituir, a través de la razón práctica, la buena voluntad de actuar según el deber. El imperativo categórico y la autonomía de la voluntad del legislador universal se conceptualizan para identificar la dignidad de la persona humana, teniendo al hombre como fin en sí mismo. Se demuestra que el hombre es poseedor de deberes (responsabilidades)/derechos (libertad-autonomía de la voluntad). Se identifican los aspectos del fundamento ético de la dignidad humana para compararlos con los principios actuales del derecho internacional público. METODOLOGÍA: La investigación es bibliográfica cualitativa, centrada en la "Fundamentación de la Metafísica de las Costumbres" de Immanuel Kant, seguida del análisis de libros y artículos científicos sobre el tema. Siguiendo el análisis doctrinal, el tema está relacionado con la exposición de los artículos de los tratados internacionales del sistema de protección de los derechos humanos. CONCLUSIONES: La investigación se justifica en función de la necesidad ética universal de vincular el derecho nacional con el internacional, independientemente de las normas internacionales positivizadas, según las exigencias contemporáneas frente a todos los poderes establecidos, oficiales o no. Se concluye que una organización internacional fundada en principios basados en la moral universal es necesaria para la protección de la dignidad humana con el fin de lograr la paz.PROBLEMÁTICA: A problemática do presente artigo discute como a proposta da ética universalista de Kant pode sustentar a fundamentação universal da dignidade humana, tendo como foco a teoria filosófica kantiana, através da análise da obra A Fundamentação da Metafísica dos Costumes. Este artigo relaciona a concepção filosófica kantiana com as matérias de Direito Internacional Público dos Direitos Humanos. OBJETIVOS: O estudo objetiva entender a necessidade das leis morais a priori para se constituir, através da razão prática, a boa vontade de agir conforme o dever. Conceitua-se o imperativo categórico e a autonomia da vontade do legislador universal para identificar a dignidade da pessoa humana, tendo o homem como fim em si. Demonstra-se o homem sendo possuidor de deveres (responsabilidades)/direitos (liberdade- autonomia da vontade). Identificam-se os aspectos da fundamentação ética da dignidade humana para compará-los com os atuais princípios do direito internacional público. METODOLOGIA: A pesquisa é bibliográfica qualitativa, com foco na obra “A Fundamentação da Metafísica dos Costumes” de Immanuel Kant, seguida da análise de livros e artigos científicos sobre o tema. Na sequência da análise doutrinária, faz-se a relação do tema com a exposição de artigos de tratados internacionais do sistema de proteção aos direitos humanos. CONCLUSÕES: A pesquisa se justifica conforme a necessidade ética universal para vincular o direito pátrio com o internacional, independentemente de normas internacionais positivadas, consoante às exigências contemporâneas contra todos os poderes estabelecidos, oficiais ou não.
