The Incidence of the Coronavirus Pandemic in the Italian Constitutional System

Resumo: The present article seeks to expose the problems arising from the normative acts adopted in Italy to deal with the Covid-19 health emergency, those pertinent to Constitutional principles. It is emphasized here that the Italian Constitution does not contain, unlike other experiences nearby, an exact definition of the state of emergency or exception, which allows an open reading of the taking of "measures necessary for the reestablishment of public order and safety" and of the suspension of the effectiveness of the fundamental rights provided for. We investigate the governing concepts for the declaration of the state of emergency and the interventions made at the level of the civil protection code by means of decree-laws. Thereby, the numerous measures of the state of emergency caused by the pandemic form the catch that gives rise to conflicts with fundamental rights, from the right to free movement or health to even political participation. Finally, it is highlighted that these infractions give rise to the recognition of minority agendas that had been neglected in society and that suffered aggravation due to the impacts of the health crisis, such as the situation of women, prisoners and foreigners.

Se subraya aquí que la Constitución italiana no contiene, a diferencia de otras experiencias cercanas, una disciplina expresa del estado de emergencia o de excepción, que permita la lectura abierta de la adopción de "medidas necesarias para el restablecimiento del orden y la seguridad públicos" y la suspensión de la eficacia de los derechos fundamentales previstos. Investigamos los conceptos que rigen la declaración del estado de emergencia y las intervenciones realizadas a nivel del Código de Protección Civil a través de los decretos-ley. De este modo, las numerosas medidas del estado de emergencia provocadas por la pandemia forman el gancho que da lugar a conflictos con los derechos fundamentales, desde el derecho a la libre circulación o la salud hasta la participación política. Por último, se destaca que estas infracciones dan lugar al reconocimiento de agendas minoritarias que han sido desatendidas en la sociedad y que se han visto agravadas por los impactos de la crisis sanitaria, como la situación de las mujeres, los presos y los extranjeros.Questo articolo cerca di esporre i problemi derivanti dagli atti normativi adottati in Italia per affrontare l'emergenza sanitaria Covid-19, quelli pertinenti ai principi costituzionali. Si sottolinea qui che la Costituzione italiana non contiene, a differenza di altre esperienze vicine, una disciplina espressa dello stato di emergenza o di eccezione, che consenta l'aperta lettura dell'adozione di "misure necessarie per il ripristino dell'ordine e della sicurezza pubblica" e della sospensione dell'efficacia dei diritti fondamentali previsti. Indaghiamo i concetti che regolano la dichiarazione dello stato di emergenza e gli interventi fatti a livello del codice di protezione civile attraverso i decreti legge. In questo modo, le numerose misure dello stato di emergenza causate dalla pandemia formano il gancio che dà luogo a conflitti con i diritti fondamentali, dal diritto alla libera circolazione o alla salute fino alla partecipazione politica.
