Teacher teleworking, Digital Culture and the Changes in Labor Legislation

Resumo: The aim of this paper is to analyze teaching teleworking in the context of digital culture, considering the recent changes in Brazilian labor legislation and through a literature review of the area. The use of digital information and communication technologies (DICT) and mobile telecommunication devices has changed life in society, including working. This change had a significant impact on teachers' working hours, particularly those who perform non-present activities, exploring possibilities for telework and ubiquity. Based on scientific productions of the area, resulting from previous bibliographic survey, as well as the Brazilian legislation and the Portuguese Labor Code, we analyzed the teaching telework, with special attention to the blurring of the boundaries between the personal and professional life of the teacher. As a result of teleworking and ubiquity, made possible by DICT, some perversities for the teacher are observed, in addition to the many promises and real advantages of the process. As propositions of this reflection, we recommend the necessity of the right to disconnection, the awareness of the professional teaching class and the alteration of the relevant legislation, in favor of better working conditions for the teacher.

O intensivo uso de Tecnologias Digitais de Informação e Comunicação (TDIC) e de dispositivos móveis de telecomunicação alterou a vida em sociedade, inclusive o exercício laboral. Tal mudança repercutiu significativamente sobre a jornada de trabalho dos professores, particularmente aqueles que realizam atividades não presenciais, explorando possibilidades do teletrabalho e da ubiquidade. Baseando-se em produções científicas da área, resultantes de prévio levantamento bibliográfico, bem como na legislação brasileira e no Código do Trabalho de Portugal, analisamos o teletrabalho docente, com atenção especial à diluição das fronteiras entre a vida pessoal e profissional do professor. Em decorrência do teletrabalho e da ubiquidade, viabilizada pelas TDIC, são observadas algumas perversidades para o ofício de mestre, para além das muitas promessas e reais vantagens do processo.
