The necrocitizenship and the post mortem legal restriction

Resumo: This work aims to develop the concept of necrocitizenship, in addition to demonstrate its practical feasibility and enumerating the barriers that are encountered for its effective exercise. A theoretical-speculative research was developed, based on the critical reading of works on the subject, selected within the literature about funeral rites (in the West and in other civilizations), the mourning process, the relationship with the corpse and also within the legal framework. Thus, it was discussed about the legislative problems that involve the question of the disposition of the body. For the conceptualization of necrocitizenship, concepts such as citizenship and control of bodies were taken to a post mortem perspective. As a result, the concept of necrocitizenship can be applied and becomes effective through organ donation, body donation for science and through environmental concern.

Este trabajo pretende desarrollar el concepto de necrociudadanía, además de demostrar su viabilidad práctica y enumerar las barreras que se encuentran para su ejercicio efectivo. Se desarrolló una investigación teórico-especulativa, a partir de la lectura crítica de obras sobre el tema, seleccionadas dentro de la literatura sobre los ritos funerarios (en Occidente y en otras civilizaciones), el proceso del duelo, la relación con el cadáver y, también, dentro del marco legal. Así, se discutieron los problemas legislativos que envuelven la cuestión de la disposición del cuerpo. Para la conceptualización de la necrociudadanía se llevaron a una perspectiva post mortem conceptos como ciudadanía y control de los cuerpos. Como resultado, el concepto de necrociudadanía puede aplicarse y se hace efectivo a través de la donación de órganos, la donación de cuerpos para la ciencia y la preocupación por el medio ambiente.Este trabalho tem como objetivos desenvolver o conceito de necrocidadania, além de demonstrar sua viabilidade prática e enumerar as barreiras que são encontradas para seu efetivo exercício. Foi desenvolvida uma pesquisa teórico-especulativa, baseada na leitura crítica de obras sobre o tema, selecionadas no interior da literatura a respeito dos ritos funerários (no Ocidente e em outras civilizações), do processo de luto, da relação com o cadáver e, também, dentro do âmbito jurídico. Assim, discorreu-se sobre as problemáticas legislativas que envolvem a questão da disposição do corpo. Para a conceituação de necrocidadania, conceitos como cidadania e controle dos corpos foram levados para uma perspectiva post mortem. Como resultado, o conceito de necrocidadania pode ser aplicado e efetiva-se através da doação de órgãos, da doação do corpo para a ciência e através da preocupação ambiental.
