Despite the recognition of human rights in the international sphere on the occasion of the 1948 Universal Declaration of Human Rights, its practical application is not always easy to achieve. Therefore, the scope of this article is to analyze how the protection of human rights in relation to minorities, especially the traditional peoples of Latin America, develops. The general objective is to awaken in the reader the critical thinking about Decoloniality and to draw their attention to the importance of seeking an intercultural Human Rights that meets the true aspirations of the traditional populations, where their diversity is recognized. The specific objective is to analyze how has been the search for the protection of the rights of these people from the jurisprudence of the Inter-American Court of Human Rights (IACHR). For this, the work uses bibliographic methods as specialized doctrine and international and regional legal instruments that allow better perception about the reality of the evolution of international law in the protection of the rights of traditional peoples. Therefore, the present theme is current and deserves the attention of the region al and international community in order to promote more efficient public policies and that the system of protection of the human rights of traditional peoples is constantly on the rise.
