Arendt, Hirschl and Brazil: the brazilian judiciary as a politically engaged actor in the 30 years of the Constitution

Resumo: The present work intends to establish a counterpoint between the expectation of Hannah Arendt, for whom the Judiciary would represent the locus of truth in opposition to the absolute lie that would have found its hypertrophy in politics, and the idea of juristocracy developed by Ran Hirschl, based on the performance of the Brazilian judiciary. To that end, Arendt's theory of the judiciary as the locus of truth is initially developed. Following are the main constituent elements of Hirschl's theory of juristocracy and how an alignment of the judiciary with economic and political elites occurs. Finally, it is made an analysis of how the performance of the Brazilian judiciary, specially the Brazilian Supreme Court, at the moment in which the Brazilian Constitution celebrates 30 years, represents, rather than the political engagement of the institution, its alignment with the interests of the country's political and economic elites

Para ello, se trabaja inicialmente la teoría de Arendt sobre el poder judicial como locus de la verdad. A continuación, se presentan los principales elementos constitutivos de la teoría de la juristocracia de Hirschl y cómo el poder judicial se alinea con las élites económicas y políticas. Por último, se analiza cómo la actuación del poder judicial brasileño, especialmente del Supremo Tribunal Federal en un momento en el que la Constitución brasileña cumple 30 años, representa no sólo el compromiso político de la institución, sino su alineación con los intereses de las élites políticas y económicas del país.O presente trabalho pretende estabelecer uma contraposição entre a expectativa de Hannah Arendt, para quem o Poder Judiciário representaria o locus da verdade em oposição à mentira absoluta que teria encontrado sua hipertrofia na política, e a ideia de juristocracia desenvolvida por Ran Hirschl, com base na atuação do judiciário brasileiro. Para tanto, incialmente é trabalhada a teoria de Arendt sobre o judiciário como locus da verdade. Na sequência são apresentados os principais elementos constitutivos da teoria da juristocracia de Hirschl e sobre como ocorre um alinhamento do poder judiciário com as elites econômicas e políticas.
