The performance of the STF in the First Republic: an analysis of path dependency in the years 1914 to 1924

Resumo: This article aims to portray the performance of the Supreme Court (STF) in the First Republic in the years 1914 to 1924, period in which its institutional affirmation took place. Using the theoretical perspectives of Historical Neoinstitutionalism, the research analyzes the recurrence of STF deliberations to characterize the modus operandi in the face of institutional dynamics. For this purpose, path dependency is used as an explanatory vector, founded on contextual elements that influence the pragmatism of institutions. This analytical lens leads to causal deductions and, at the same time, seeks to explain how the historical environment acts on individuals in their successive and accumulated actions over time. This is because institutions are in a synchrony of causality in relation to temporal reflexes, although determinism is not configured. For the concreteness of the proposed objectives, bibliographic and documental sources are used with quantitative and qualitative analysis based on the “Activity Reports of the Federal Supreme Court” for the years studied, through the Process Tracing tool. Even in a preliminary way, it is concluded that the Court acted as a kind of “sounding board” of the political and social process within the research cutout through its mechanisms of action – the procedural typologies.

Utilizando las perspectivas teóricas del Neoinstitucionalismo Histórico, la investigación analiza la recurrencia de las deliberaciones del STF para caracterizar el modus operandi frente a la dinámica institucional. Para ello, se utiliza la dependencia de la trayectoria como vector explicativo, a partir de elementos contextuales que influyen en el pragmatismo de las instituciones. Esta lente analítica conduce a deducciones causales y, al mismo tiempo, busca explicar cómo el entorno histórico actúa sobre los individuos en sus acciones sucesivas y acumuladas a lo largo del tiempo. Esto se debe a que las instituciones se colocan en una sincronía causal en relación con los reflejos temporales, aunque no es determinismo. Para la concreción de los objetivos propuestos, se utilizan fuentes bibliográficas y documentales con análisis cuantitativo y cualitativo en base a los “Informes de Actividad de la Corte Suprema de Justicia” de los años estudiados, a través de la herramienta Process Tracing. Incluso de manera preliminar, se concluye que la Corte actuó como una especie de “caja de resonancia” del proceso político y social dentro del recorte de investigación a través de sus mecanismos de acción, las tipologías procesales.Este artigo se propõe a retratar a atuação do Supremo Tribunal Federal (STF) na Primeira República nos anos de 1914 a 1924, período em que se deu a sua afirmação institucional. Utilizando-se das perspectivas teóricas do Neoinstitucionalismo Histórico, a pesquisa analisa a recorrência das deliberações do STF para caracterizar o modus operandi em face da dinâmica institucional. Para isso toma-se como vetor explicativo a path dependency, fundada em elementos contextuais que influem sobre o pragmatismo das instituições. Esta lente analítica leva a deduções causais e, ao mesmo tempo, procura explicar como o meio histórico age sobre os indivíduos em suas ações sucessivas e acumuladas ao longo do tempo. Isto, porque as instituições colocam-se dentro de uma sincronia de causalidade em relação aos reflexos temporais, embora não se configure um determinismo. Para a concretude dos objetivos propostos são utilizadas fontes bibliográficas e documentais com análise quantitativa e qualitativa com base nos “Relatórios de Atividades do Supremo Tribunal Federal” relativos aos anos estudados, através da ferramenta do Process Tracing.
