Democracy, State andanti-corruption fighting in the political and juridical thinking of Sergio Fernando Moro

Resumo: This paper analyzes the formation of the political thinking of the Brazilian federal judge Sergio Fernando Moro from four articles written by him, as well as the translation of the work of an American promoter, between the years of 1999 and 2008, period which he’s segmented in the magistracy as specialized judge in cases of organized crime, corruption and money laundering. The synthesis of works comparison shows how the judge formed a political thought in which the Judiciary should be superimposed on the other republican powers, since for him the source of all corruption comes from politics and public administration, captured by evildoers who occupy positions in the Legislative and in the Executive houses. In this way, the very nature of the work and the selection processes by merit in a public competition gives to the judge the power to reinterpret laws, replace legal obligations with moral arguments, and substitute evidence for the support of “public opinion”.

La síntesis de la comparación de los trabajos muestra cómo el juez formó un pensamiento político en el que el Poder Judicial debe superponerse a los demás poderes republicanos, porque, para él, la fuente de toda corrupción proviene de la política y de la administración pública, que son capturadas por malhechores que ocupan cargos en los poderes Legislativo y Ejecutivo. De esta forma, la propia naturaleza del cargo y de los procesos de selección de méritos en concurso público otorga al juez el poder de reinterpretar las leyes, sustituir las obligaciones legales por argumentos morales y suplantar las pruebas indiciarias por el apoyo de la "opinión pública".Este trabalho analisa a formação do pensamento político do juiz federal Sergio Fernando Moro a partir de quatro artigos escritos por ele, bem como a tradução do trabalho de um promotor estadunidense, entre os anos de 1999 e 2008, período em que se segmentou na magistratura como juiz especializado em casos de crime organizado, corrupção e lavagem de dinheiro. A síntese da comparação dos trabalhos mostra como o juiz formou um pensamento político no qual o Poder Judiciário deve ser sobreposto aos demais poderes republicanos, pois, para ele, a fonte de toda corrupção vem da política e da administração pública, os quais são capturados por malfeitores que ocupam cargos no Legislativo e no Executivo.
