Access to information and justice in the Western Amazon:: socio-spatial segregation as an obstacle to granting disability benefits in the municipality of Lábrea/AM

Resumo: The study of City Law, emerged in France under the hands of Henry Lefebvre in 1968 and is perpetuated in contemporary times with an important potential for modifying everyday life in the search for integrative public policies. From this perspective, this work investigates the determining factors of socio-spatial segregation that hinder access to justice and information in the municipality of Lábrea, located in the Cisandina Amazon region. With the advent of the economic policy of latex extraction, which gave national and international prominence to the metropolitan region of Manaus/AM in the period of the tropical belle époque, there was a distancing of public policies in relation to the Amazonian interior, a fact that persisted even after the decline of the referred policy and migration of the rubber tappers to the interior regions where the rivers head (in order to subsist on family farming or fishing) and which persists until the present moment. The study uses the dialectical-deductive method and bibliographical research to analyze how socio-spatial segregation impacts access to justice and information in granting disability benefits. The work also evaluates whether there is municipal omission in the provision of medical expertise and social assessments in the municipality of Lábrea-AM, as well as itinerant justice in the judicial system of Amazonas. The main reference works used deal with access to justice in the Amazon, social vulnerability in the riverside region of the Amazon and access to justice during the pandemic, in addition to information from the Brazilian Federal Government and the Court of Justice of Amazonas. Measures are proposed that can work as vectors of access to the social security and assistance rights of the INSS and the judicial system.

Desde esta perspectiva, este trabajo investiga los determinantes de la segregación socioespacial que dificultan el acceso a la justicia y la información en el municipio de Lábrea, ubicado en la Amazonía Cisandina. Con el advenimiento de la política económica de extracción de látex, que dio protagonismo nacional e internacional a la región metropolitana de Manaus/AM en el período de la belle époque tropical, hubo un distanciamiento de las políticas públicas en relación al interior amazónico, hecho que persistió aún después del declive de la citada política y la migración de los caucheros hacia las regiones interiores donde nacen los ríos (para subsistir de la agricultura familiar o de la pesca) y que persiste hasta el momento actual. El estudio utiliza el método dialéctico-deductivo y la investigación bibliográfica para analizar cómo la segregación socioespacial impacta el acceso a la justicia y la información en el otorgamiento de beneficios por discapacidad. El trabajo también evalúa si existe omisión municipal en la prestación de peritajes médicos y peritajes sociales en el municipio de Lábrea-AM, así como justicia itinerante en el sistema judicial de Amazonas. Los principales trabajos de referencia utilizados tratan sobre el acceso a la justicia en la Amazonía, la vulnerabilidad social en la región ribereña de la Amazonía y el acceso a la justicia durante la pandemia, además de informaciones del Gobierno Federal de Brasil y del Tribunal de Justicia de Amazonas. Se proponen medidas que pueden funcionar como vectores de acceso a los derechos de seguridad social y asistencial del INSS y del sistema judicial.O estudo do Direito da Cidade, eclode no seio francês sob as mãos de Henry Lefebvre em 1968 e perpetua na contemporaneidade com importante potencial de modificação do cotidiano citadino na busca por políticas públicas integrativas. Com o advento da política econômica de extrativismo do látex, que conferiu destaque nacional e internacional à região metropolitana de Manaus/AM no período da belle époque tropical, houve o distanciamento das políticas públicas em relação ao interior amazonense, fato que persistiu mesmo após o declínio da referida política e migração dos seringueiros para as regiões interioranas de encabeçamento dos rios (a fim de subsistir em regime de agricultura familiar ou pesca) e que persiste até o presente momento. O estudo utiliza o método dialético-dedutivo e a pesquisa bibliográfica para analisar como a segregação socioespacial impacta o acesso à justiça e à informação na concessão de benefícios por incapacidade. O trabalho também avalia se há omissão autárquica na oferta de perícias médicas e avaliações sociais no município de Lábrea-AM, assim como a justiça itinerante no sistema judiciário do Amazonas. As principais obras de referência utilizadas, versam sobre o acesso à justiça no Amazonas, a vulnerabilidade social na região ribeirinha da Amazônia e o acesso à justiça durante a pandemia, além de informações do Governo Federal Brasileiro e do Tribunal de Justiça do Amazonas.
