Resumo: | Hate speech is an important problem for the Brazilian legal debate. Its reverberation can be seen as a reflection of our past, full of injustices against minority groups. It is a famous argument in American political theory that hate speech is covered by freedom of speech. It would only be necessary to repair afterwards any psychic damage, a thesis that has been accepted by the labor jurisprudence in Brazil in cases of indirect discrimination in the workplace. This article seeks to problematize this thesis based on Jeremy Waldron's arguments in the book “The harm in the hate speech” (2012), in order to promote a criticism based on principles of justice to this line of thought in Brazil. The hypothesis of this article is that tolerance is a diffuse right that is part of what is called in the labor law doctrine “the right to an adequate work environment.” This is because tolerance ensures the conditions for the exercise of autonomy that accompanies the moral status of dignity. Unlike cases of offenses, it will be argued that, for cases of hate speech, not only the filing of a class action for the defense of a diffuse right, but also the prior regulation of this type of speech, which, if it circulates freely, may have the effect of compromising the conditions for the exercise of autonomy inherent to the dignity of the agents of a certain minority group, affecting, for example, their chances of obtaining promotions and social esteem for their work. |

Su reverberación puede verse como un reflejo de nuestro pasado, lleno de injusticias contra los grupos minoritarios. Es un famoso argumento de la teoría política estadounidense que el discurso del odio está amparado por la libertad de expresión. Sólo sería necesario reparar posteriormente cualquier daño psíquico, tesis que ha sido aceptada por la jurisprudencia laboral en Brasil en casos de discriminación indirecta en el ambiente de trabajo. Este artículo busca problematizar esta tesis a partir de los argumentos de Jeremy Waldron en el libro "The harm in the hate speech" (2012), con el fin de promover una crítica basada en principios de justicia a esta corriente en Brasil. La hipótesis de este artículo es que la tolerancia es un derecho difuso que forma parte de lo que en la doctrina jurídico-laboral se denomina “derecho a un entorno de trabajo adecuado.” Esto se debe a que la tolerancia garantiza las condiciones para el ejercicio de la autonomía que acompaña al estatus moral de la dignidad. A diferencia de los casos de ofensas, se argumentará que, en los casos de discursos de odio, no sólo procede la interposición de una acción colectiva para la defensa de un derecho difuso, sino también la regulación previa de este tipo de discursos que, si circulan libremente, pueden tener el efecto de comprometer las condiciones de ejercicio de la autonomía inherente a la dignidad de los agentes de un determinado grupo minoritario, afectando, por ejemplo, a sus posibilidades de obtener ascensos y a la valoración social de su trabajo.O discurso de ódio é um problema importante para o debate jurídico brasileiro. A sua reverberação pode ser vista como reflexo do nosso passado, recheado de injustiças contra grupos minoritários. Ocorre que é um argumento famoso na teoria política estadunidense a ideia de que o discurso de ódio estaria abarcado pela liberdade de expressão. Caberia apenas a reparação posterior a eventual dano psíquico, tese que vem sendo recepcionada pela jurisprudência trabalhista no Brasil em casos de discriminação indireta no ambiente de trabalho. Este artigo busca problematizar essa tese a partir dos argumentos de Jeremy Waldron no livro “The harm in the hate speech” (2012), para fins de promover uma crítica fundada em princípios de justiça a essa corrente no Brasil. A hipótese deste artigo é a de que a tolerância é um direito difuso integrante do que se chama na doutrina justrabalhista de “direito a um meio ambiente do trabalho adequado.” Isso porque a tolerância assegura as condições para o exercício da autonomia que acompanha o status moral da dignidade.
