The transnational and (con)federated legal semantics of the multi-level system of the European Union

Resumo: This article explores whether the concept of multilevel governance or regulation is applicable to a contemporary analysis of the exercise of power in a territory, beyond nation-state theories. It proposes that the federal state is a strategy for adjusting domestic public law to a global context, which brings together different interests in a single forum where power is exercised. In a case study, the text observes that the European Union resorts to a (con)federated arrangement to structure and harmonize powers of various sources and natures. To this end, it mobilizes critical, transnational and global perspectives on the development of legal thought and constitutionalism, aiming to demonstrate how law, as a language, functions as a semantic funnel for accommodating and reconciling pluralisms. The contribution of this article is a zetetic legal discussion on multi-level systems, especially in the context of (con)federated states, with a demonstration of its application in the development of the European Union. This study, however, has no dogmatic pretensions of pursuing or pinpointing a specific and definitive legal concept of a multi-level system. Its methodological approach is a contextual analysis of the usefulness of law in structuring multi-level governance beyond the singular nation-state.

La propuesta de investigación es que la forma (con)federada de Estado es un mecanismo de adaptación del derecho público interno al contexto globalizado, que reúne intereses divergentes en un mismo foro de ejercicio del poder. En un estudio de caso, el texto observa que la Unión Europea se sirve de una organización (con)federada para estructurar y armonizar poderes de distinta procedencia y naturaleza. Para ello, se movilizan perspectivas críticas, transnacionales y globales sobre el desarrollo del pensamiento jurídico y el constitucionalismo, con el objetivo de demostrar cómo el derecho, en tanto que lenguaje, funciona como filtro semántico para acoger y tender puentes entre pluralidades. De este modo, la contribución de este artículo es una discusión jurídica cetética sobre sistema multinivel, especialmente en el contexto del Estado (con)federado, ilustrada con una demostración de su aplicación en el desarrollo de la Unión Europea. El estudio, sin embargo, no tiene pretensiones dogmáticas de seguir o señalar un concepto jurídico específico y definitivo de sistema multinivel, sino que se centra en un análisis contextual de la utilidad del derecho para estructurar la gobernanza multinivel más allá del Estado singular.Este artigo explora a aplicabilidade do conceito de governança ou regulação multinível para uma análise contemporânea do exercício do poder em um território, para além das teorias do Estado-nação. A proposição da pesquisa é a de que a forma (con)federada de Estado é um mecanismo de adaptação do direito público interno ao contexto globalizado, que reúne interesses divergentes a um mesmo fórum de exercício de poder. Em estudo de caso, o texto observa que a União Europeia recorre a uma organização (con)federada para estruturar e harmonizar poderes de diversas fontes e naturezas. Para tanto, são mobilizadas vertentes críticas, transnacionais e globais sobre o desenvolvimento do pensamento jurídico e o constitucionalismo, com o intuito de demonstrar como o direito, enquanto linguagem, funciona como filtro semântico de acolhimento e colmatação de pluralidades. Desse modo, a contribuição deste artigo é uma discussão jurídica zetética sobre sistemas multiníveis, em especial no contexto do Estado (con)federado, ilustrada por uma demonstração de sua aplicação no desenvolvimento da União Europeia.
