Latin America and clinical education in human rights

Resumo: The work presented here is the result of an interdisciplinary research that seeks to describe and analyze the relationship between legal education and the clinical method of learning in Latin America. It seeks to present, through a critical analysis, an answer to the question about what is the specificity and impacts that legalclinics produce in Latin America. Based on an exploratory bibliographical review, we sought to make some theoretical approximations regarding a second question about how they seek to reformulate traditional legal education? It is proposed to discuss the impacts generated by human rights clinics in legal education and in the protection of human rights in the context of crisis experienced in the region, presenting how the clinical method and the institution of legal clinics turn to the discussion about the new rights and the education as a possible tool. The relevance of the theme is revealed since it is urgent for students to have an integral human formation to act in human rights. The results and conclusions comprise the formulation of legal clinics as necessary spaces for the student transformation, of legal education beyond the horizons of the traditional method of transmission of knowledge in the classrooms of the faculties of Law.

Se busca presentar, a través de un análisis crítico, una respuesta a la pregunta sobre cuál es la especificidad y los impactos que producen las clínicas jurídicas en América Latina. Basado en una revisión bibliográfica exploratoria, se buscó realizar algunas aproximaciones teóricas respecto a una segunda interrogante acerca de ¿cómo se busca reformular la educación jurídica tradicional? Se propone discutir los impactos generados por las clínicas de derechos humanos en la educación jurídica y en la protección de los derechos humanos en el contexto de crisis vivido en la región, presentando cómo el método clínico y la institución de las clínicas jurídicas se vuelcan a la discusión sobre los nuevos derechos y la educación como herramienta posible. Se revela la relevancia del tema ya que urge que los estudiantes tengan una formación humana integral para actuar en derechos humanos. Los resultados y conclusiones comprenden la formulación de las clínicas jurídicas como espacios necesarios para la transformación de los estudiantes, de la educación jurídica más allá de los horizontes del método tradicional de transmisión de saberes en las aulas de las facultades de Derecho.O trabalho ora apresentado resulta de uma pesquisa de caráter interdisciplinar que busca descrever e analisar as relações entre educação jurídica e método clínico de aprendizagem na América Latina. Busca-se apresentar por meio de uma análise crítica uma resposta à indagação sobre qual é a especificidade e os impactos que as clínicas jurídicas produzem na América latina. A partir de uma revisão bibliográfica de caráter exploratório, buscou-se realizar aproximações teóricas para responder em que medida é possível reformular o ensino jurídico tradicional? Propõe-se discutir os impactos gerados pelas clínicas de direitos humanos no ensino jurídico e na proteção dos direitos humanos no contexto de crise experenciado na região, apresentando como o método clínico e a instituição de clínicas jurídicas se voltam à discussão acerca dos novos direitos e da educação como uma possível ferramenta. A relevância da temática se revela uma vez que é urgente aos discentes uma formação humana integral para a atuação em direitos humanos.
