The Theory of the Brazilian Constitution: Constituent Process and the Legitimacy of the Constitution - Homage to Menelick de Carvalho Netto on the 30th Anniversary of the Constitution of the Federative Republic of Brazil

Resumo: When we analyse the research and teaching of constitutional law in Brazil on the eve of the thirtieth anniversary of our constitution, we will certainly come to the conclusion that the thought of Menelick de Carvalho Netto occupies a prominent place. Owner of a disperse work, the Minas Gerais constitutionalist influenced and influences generations of researchers who either occupy prominent places in Brazilian academia, or aspire one day to occupy them. Not very adept at the practice of writing and publishing, it is too difficult to precisely locate the place of departure and arrival of his approaches, his thought is spread in pages published in legal journals, in prefaces to long out-of-print books, in translations that circulate clandestinely the law faculties (REZENDE, 2017, p. 184) and, above all, in the training and theoretical maturing of his students. It is from his texts and teachings in the classroom that we will address issues about the constituent process and the legitimacy of our constitution.

Dueño de una obra dispersa, el constitucionalista de Minas Gerais influyó e influye en generaciones de investigadores que ocupan lugares destacados en la academia brasileña, o aspiran a ocuparlos algún día. Poco adepto a la práctica de la escritura y la publicación, es demasiado difícil ubicar con precisión el lugar de partida y llegada de sus planteamientos, su pensamiento se difunde en páginas publicadas en revistas jurídicas, en prólogos de libros largamente agotados, en traducciones que circulan clandestinamente las facultades de derecho (REZENDE, 2017, p. 184) y, sobre todo, en la formación y maduración teórica de sus alumnos. A partir de sus textos y enseñanzas en el aula abordaremos cuestiones sobre el proceso constituyente y la legitimidad de nuestra constitución.Ao analisarmos a pesquisa e ensino do direito constitucional no Brasil às vésperas do trigésimo aniversário de nossa constituição, certamente chegaremos à conclusão de que o pensamento de Menelick de Carvalho Netto ocupa um lugar de destaque. Dono de uma obra dispersa, o constitucionalista mineiro influenciou e influencia gerações de pesquisadores e pesquisadoras que, ou ocupam lugares de destaque na academia brasileira, ou aspiram um dia ocupá-los. Não muito adepto à prática da escrita e publicação, é demasiado difícil localizar com precisão o local de partida e a chegada de suas abordagens, seu pensamento encontra-se espraiado em páginas publicadas em periódicos jurídicos, em prefácios a livros há muito esgotados, em traduções que circulam clandestinamente as faculdades de direito (REZENDE, 2017, p. 184) e, sobretudo, na formação e no amadurecer teorético de seus orientandos e orientandas.
