Control of megapolitics by the judiciary in the debates of the constituent/88

Resumo: The work focuses on one of the most cogent themes in postmodern democracies: the tension between democratic principles and the judicialization of megapolitics, focusing on the Brazilian case, how such conflict is shaped in Brazil. The arrival of issues of pure politics to the STF will be addressed, with the questioning of the democratic credential of unelected and irresponsible judges before the population, even deciding on the reason for the existence of society, with the main objective to analyze whether the effects of the judicialization of megapolitics weakens the democratic institutions, focusing on the STF. It is a documentary research with analysis of the minutes of the sessions of the National Constituent Assembly and in literature in search of the anatomy of the Court thought by the constituents and the principles that guide the institution. Throughout the article, a theoretical framework is presented about the State, separation of powers, democracy and compared with the practice of judicial control of pure politics by the STF. Finally, it brings the debates of the National Constituent Assembly (ANC) with the aim of finding the fittings that the constituents geared the STF with the other institutions of Brazilian democracy, and verifying the democratic compatibility of the judicial control of pure politics.

Se abordará la llegada de cuestiones de pura política al STF, con el cuestionamiento de la credencial democrática de jueces no electos e irresponsables ante la población, incluso decidiendo sobre la razón de ser de la sociedad, con el objetivo principal de analizar si los efectos de la judicialización de la megapolítica debilitan las instituciones democráticas, centrándose en el STF. Es una investigación documental con análisis de las actas de las sesiones de la Asamblea Nacional Constituyente y en la literatura en busca de la anatomía de la Corte pensada por los constituyentes y los principios que orientan la institución. A lo largo del artículo, se presenta un marco teórico sobre el Estado, la separación de poderes, la democracia y se compara con la práctica del control judicial de la política pura por parte del STF. Finalmente, trae los debates de la Asamblea Nacional Constituyente (ANC) con el objetivo de encontrar los encajes que los constituyentes engranaron el STF con las demás instituciones de la democracia brasileña, y verificar la compatibilidad democrática del control judicial de la política pura.  O artigo pousa em um dos temas mais cogentes nas democracias pós-modernas: a tensão entre os princípios democráticos e a judicialização da megapolítica, com enfoque no caso brasileiro, como tal conflito se molda no Brasil. Será abordada a chegada de questões de política pura ao STF, com o questionamento da credencial democrática de juízes não eleitos e irresponsáveis perante a população decidindo até no motivo de existir da sociedade, com o objetivo principal de analisar se os efeitos da judicialização da megapolítica debilitam as instituições democráticas, focando no STF. É uma pesquisa documental com análise das atas das sessões da Assembleia Nacional Constituinte (ANC) e de literatura na busca da anatomia da Corte pensada pelos constituintes e os princípios que norteiam a instituição. Ao longo do artigo é apresentado referencial teórico acerca de Estado, da separação dos poderes, da democracia e cotejado com a prática do controle judicial da política pura pelo STF.
