The contribution of operacional audits to the external control of public policies

Resumo: The article examines the control of the state's performative activity as a democratic mechanism to the balanced promotion of fundamental and social rights, highlighting the contribution of operational audits to the external control of public policies. Based on the deductive method and bibliographical research, the article argues that the effectiveness of fundamentalrights requires a rapprochement between sollenand sein, harmonizing the axiological constraints imposed by proceduralism and substantialism, especially in times of openness of the State to the pressures of the Market and the Society. Given the complexityand dynamicity of the contemporary world, performative activity of the State turned to the public policies and to the new techniques of public management, highlighting the importance of material control of results. Considering the discussions about judicial control of public policies, due to the democratic deficit of the Judiciary, the limits arising from the separation of powers and the difficulties in the promotion of "macrojustice", the comparative institutional analysis reveals the potentialities of the Auditing Courts in the control of public policies and the promotion of fundamental and social rights, considering the evolution of external control based on operational audits.

A partir del método deductivo y de la investigación bibliográfica, el artículo sostiene que la efectividad de los derechos fundamentales requiere un acercamiento entre sollen y sein, armonizando las limitaciones axiológicas impuestas por el procedimentalismo y el sustancialismo, especialmente en tiempos de apertura del Estado a las presiones del Mercado y de la Sociedad. Ante la complejidad y el dinamismo del mundo contemporáneo, la actividad performativa del Estado se ha volcado hacia las políticas públicas y las nuevas técnicas de gestión pública, destacando la importancia del control material de los resultados. Frente a las discusiones sobre el control judicial de las políticas públicas, debido al déficit democrático del Poder Judicial, a los límites derivados de la Separación de Poderes y a las dificultades para promover la "macrojusticia", el análisis institucional comparado revela el potencial de los Tribunales de Cuentas en el control de las políticas públicas y en la promoción de los derechos fundamentales y sociales, frente a la evolución del control externo a partir de auditorías operativas.O artigo examina o controle da atividade performativa do Estado, como mecanismo democrático para a promoção equilibrada dos direitos fundamentais e sociais, ressaltando a contribuição das auditorias operacionais para o controle externo das políticas públicas. Baseado no método dedutivo e na pesquisa bibliográfica, o artigo defende que a efetividade dos diretos fundamentais exige a reaproximação entre sollen e sein, harmonizando as condicionantes axiológicas impostas pelo procedimentalismo e pelo substancialismo, principalmente em tempos de abertura do Estado para as pressões do Mercado e da Sociedade. Dada a complexidade e a dinamicidade do mundo contemporâneo, a atividade performativa do Estado voltou-se para as políticas públicas e para as novas técnicas de gestão pública, destacando a importância do controle material de resultados.
