The 2018 elections: an interpretation based on Bobbio

Resumo: The article uses the perspective of the fierce ideological conflict during the 2018 election to discuss the figure of the Democratic State of Law through a context, not of division and conflict, but of political unity around the very idea of conflict and the interpretation of the election as a war for power and for the future of the country. Tangentially, a brief critique is made of the increasingly common use of meta-juridical principles to determine the democratic character of a government, since the idea of democracy is umbilically connected to modern Constitutional Law. For this end, some concepts presented in Norberto Bobbio's The Ideologies and Power in crisis, together with other ideas from renowned authors, are used throughout the work.

Tangencialmente, se hace una breve crítica al uso cada vez más común de los principios metajurídicos para determinar el carácter democrático de un gobierno, ya que la idea de democracia está umbilicalmente conectada al Derecho Constitucional moderno.   Para ello, se adoptan algunos conceptos presentados en Las ideologías y el poder en crisis, de Norberto Bobbio, junto con ideas de otros autores de renombre.O artigo utiliza a perspectiva do acirrado conflito ideológico durante a eleição de 2018 para discutir a figura do Estado Democrático de Direito através de um contexto, não de divisão e conflito, mas, de unidade política em volta da própria ideia de conflito e da interpretação da eleição como guerra pelo poder e pelo futuro do país.
