The institutional imbalance between the Republican Powers: structural and circumstantial elements and the phenomenon of the judicialization of politics

Resumo: | The current Brazilian State was structured under a constitutional order with a functional division into three bodies, legally called powers. Despite the fact that the constitutional normative organization seeks to ideally reproduce the theoretical plan of the notion of separation of functions and the mechanisms of “checks and balances” between the constituted powers, it is observed that the balance of forces between them in the practical plan of the Brazilian reality demonstrates that this expected balance does not work exactly as abstractly thought, with cases of frank hypertrophy cycles of one power over the others being frequent, or even of general disarray between all the constituted powers, as recently occurred in the case of the judgment by the STF of the secret budget, a matter that involved the simultaneous balance of forces between the three powers, culminating in a scenario that greatly disorganized the proper functioning of the Brazilian State and its institutions. Under these theoretical premises, the objective is to analyze, through a legal-political approach, the contributory elements for the formation of the current dynamic balance of forces that involves the three republican powers. Specifically, the objective is to investigate some of the institutional and political factors that potentially contribute to the imbalance of forces between the powers, seeking to answer whether the imbalance of forces between the powers has circumstantial causalities, at the moment, or if they are due to bad institutional design of the separation of powers, hence of structural causalities. As a methodology, basic bibliographical research is adopted, approaching the themes with a legal-political analysis focus, however without intending to focus on the in-depth theoretical examination of dogmatic categories. |

El Estado brasileño actual se estructuró bajo un orden jurídico constitucional a través de una división funcional en tres órganos, legalmente llamados poderes. A pesar de la organización normativa constitucional que busca reproducir idealmente el plan teórico de la noción de separación de funciones y los mecanismos de “frenos y contrapesos” entre los poderes constituidos, se observa que el equilibrio de fuerzas entre ellos en el plan práctico del gobierno brasileño la realidad demuestra que este esperado equilibrio no funciona exactamente como se pensaba en abstracto, con frecuentes casos de ciclos de franca hipertrofia de un poder sobre otros, o incluso de desajuste general entre todos los poderes constituidos, como ocurrió recientemente en el caso de la sentencia del STF sobre el presupuesto secreto, asunto que involucró el equilibrio simultáneo de fuerzas entre los tres poderes del Estado, escenarios que, obviamente, desorganizan en gran medida el buen funcionamiento de el Estado brasileño y sus instituciones. Bajo estas premisas teóricas, el objetivo es analizar, a través de un enfoque jurídico-político, los elementos coadyuvantes para la conformación de la actual dinámica de correlación de fuerzas que involucra a los tres poderes republicanos. Específicamente, pretende indagar algunos de los factores institucionales y políticos que potencialmente contribuyen al desequilibrio de fuerzas entre los poderes, buscando responder si el desequilibrio de fuerzas entre los poderes tiene causalidades circunstanciales, en el momento, o si se deben a mal diseño institucional de la separación de poderes, por lo tanto de causalidades estructurales. Como metodología, se adopta la investigación bibliográfica básica, abordando los temas con un enfoque de análisis jurídico-político, pero sin la intención de centrarse en la profundización teórica de las categorías dogmáticas. O Estado brasileiro atual foi estruturado sob uma ordem constitucional com uma divisão funcional em três órgãos, chamados juridicamente de poderes. A despeito de a organização normativa constitucional buscar reproduzir idealmente o plano teórico da noção de separação de funções e dos mecanismos de “freios e contrapesos” entre os poderes constituídos, observa-se que o equilíbrio de forças entre eles no plano prático da realidade brasileira demonstra que esse esperado equilíbrio não funciona exatamente como pensado abstratamente, sendo frequentes os casos de ciclos de franca hipertrofia de um poder sobre os outros, ou mesmo de desarranjo geral entre todos os poderes constituídos, como ocorreu recentemente no caso do julgamento pelo STF do orçamento secreto, matéria que envolvia o equilíbrio simultâneo de forças entre os três poderes, culminando num cenário que desorganiza sobremaneira o bom funcionamento do Estado brasileiro e das suas instituições. Sob essas premissas teóricas, objetiva-se analisar, mediante uma abordagem jurídico-política, os elementos contributivos para a formação do atual equilíbrio dinâmico de forças que envolve os três poderes republicanos. Em específico, objetiva-se investigar alguns dos fatores institucionais e políticos que potencialmente contribuem para o desequilíbrio de forças entre os poderes, buscando responder se o desequilíbrio de forças entre os poderes possui causalidades circunstanciais, de momento, ou se são decorrentes do mau desenho institucional da separação de poderes, logo de causalidades estruturais.
