Resumo: The management of European borders widely uses border externalization policies. S.S. and Others v. Italy, awaiting judgment by the ECtHR, is an emblematic case. It could change how the States that apply border externalization measures are held accountable for human rights violations. This paper analyzes the legality of border externalization policies under international and European law. Subsequently, it considers the impact of the aforementioned case as a possible paradigm shift regarding the interpretation of the concept of jurisdiction. The research uses the inductive method, carrying out a bibliographical and documentary analysis. It concludes that ECtHR's precedents make it possible to soften the concept of responsibility due to the exercise of jurisdiction extraterritorially, even when the State has no direct relationship with the committed violations however did not act to prevent or prevent the violations from occurring, even knowing its probability.

S.S. y Otros contra Italia, pendiente de sentencia en el Tribunal Europeo de Derechos Humanos (TEDH), es un caso emblemático, que puede cambiar la forma en que los Estados que aplican medidas de externalización fronteriza deben rendir cuentas. El objeto de este artículo es analizar la legalidad de la política de externalización de fronteras a la luz de los estándares jurídicos internacionales y europeos. Además, se investiga el impacto del citado caso como posible cambio de paradigma en cuanto a la interpretación del concepto de jurisdicción. La investigación utiliza el método inductivo, realizándose un análisis bibliográfico y documental. Se infirió que existen precedentes del TEDH que permiten flexibilizar el concepto de responsabilidad por el ejercicio extraterritorial de la jurisdicción, aun cuando el Estado no tenga una relación directa con las violaciones, pero tampoco actuó para prevenir o impedir las de que se produzcan infracciones, aun sabiendo su probabilidad.A política de externalização de fronteiras é bastante utilizada na gestão das fronteiras europeias. S.S. e Outros c. Itália, aguardando julgamento no Tribunal Europeu dos Direitos do Homem (TEDH), é um caso emblemático, que poderá modificar a forma como os Estados que aplicam medidas de externalização de fronteiras são responsabilizados. O objetivo do presente artigo é analisar a legalidade da política de externalização de fronteiras à luz das normas internacionais e europeias. Subsequentemente, investiga-se o impacto do supramencionado caso como possível mudança de paradigma quanto à interpretação do conceito de jurisdição. A pesquisa utiliza o método indutivo, sendo realizada uma análise bibliográfica e documental.
