As principais fontes consultadas nesse trabalho foram os livros de doutrina jurídica civil, trabalhista e previdenciária entre 1904 e 1944, bem como os debates parlamentares entre 1919 e 1929, isto é, a partir do Decreto-Lei 3.724/1919 até o último ano antes do fechamento do Congresso Nacional em 1930. A partir da análise dessas fontes, foi possível concluir que, do ponto de vista da prática jurídica, o Decreto-Lei 3.724/1919, em parte pelo movimento de pacificação social que o orientou desde sua criação, presente na legislação através de mecanismos que dificultavam a sua aplicação, e em parte pela própria estrutura social do Brasil daquela época, foi subutilizado pelos operários brasileiros, muito diferente do cenário encontrado a partir de 1934, com o Decreto n. 24.637. Não obstante as diversas tentativas de reforma da legislação ao longo da década de 1920, nenhuma das tentativas prosperou por motivos políticos, em uma perspectiva que, nos debates parlamentares, polarizavam a Câmara dos Deputados e o Senado Federal. Do ponto de vista teórico, esse período de 1919 e 1944 foi palco de dois grandes deslocamentos que são fundamentais para a compreensão da natureza jurídica dos acidentes de trabalho até os dias atuais. A partir do Decreto-Lei 3.724/1919 ocorre o primeiro desses deslocamentos da discussão jurídica do campo do direito civil para o do direito do trabalho, enquanto na década de 1930, durante o período Vargas, ocorre um segundo deslocamento, dessa vez para o campo previdenciário, através das discussões acerca da necessidade de adoção do seguro social e a rejeição do modelo representado pela teoria do risco profissional.This dissertation investigates accidents at work in Brazilian legal culture between 1919 and 1944, taking as its starting point Decree-Law 3.724/1919, the first national legislation on the subject, replaced in 1934 by Decree n. 24.637. The main sources consulted in this work were the books of civil, labor and social security legal doctrine between 1904 and 1944, as well as parliamentary debates between 1919 and 1929, that is, from Decree-Law 3.724/1919 until the last year before the National Congress closed in 1930. From the analysis of these sources, it was possible to conclude that, from the point of view of legal practice, Decree-Law 3,724/1919, in part because of the social pacification movement that guided it since its creation, present in the legislation through mechanisms that made its application difficult, and in part because of the very social structure of Brazil at that time, was underused by Brazilian workers, very different from the scenario found after 1934, with Decree 24,637. Notwithstanding the several attempts to reform the legislation throughout the 1920s, none of the attempts prospered for political reasons, in a perspective that, in the parliamentary debates, polarized the Chamber of Deputies and the Federal Senate. From a theoretical point of view, the period between 1919 and 1944 was the stage of two major shifts that are fundamental for the understanding of the legal nature of accidents at work until today.
