Resumo: Brazil has the third largest prison population in the world and the number of prisoners has increased dramatically since the entry into force of Law 11,343/06, better known as the Drug Law. The State of Mato Grosso do Sul, as it borders the countries Paraguay and Bolivia, becomes a drug corridor and, as a result, a large part of the Mato Grosso do Sul prison population is made up of people arrested for the practice. of the crime of drug trafficking. Mass imprisonment resulting from trafficking targets the most socially vulnerable, that is, the poor, black and those with low education. In this context, it is important to understand the origin of the prohibition of narcotic substances and the historical and social moment in which it was and is inserted. Furthermore, the study of criminology is necessary to understand the criminal policies adopted in the war on drugs, with the help of critical criminology and labeling theory. It is imperative to discuss the effects of the Drug Law on mass imprisonment in Campo Grande/MS and verify the arguments used by magistrates in their sentences that contribute to the imprisonment of these people, using concepts from the criminal law of the enemy and the war on drugs . To meet this purpose, the research will be based on the hypothetical-deductive method, in a descriptive and exploratory manner, based on the criminology framework and bibliographical research, covering legislation, international pacts, scientific articles, jurisprudence, data provided by national agencies of research on the prison system, in addition to qualitative and quantitative research with analysis of the processes of people convicted of this crime who are at the Penal Institute of Campo Grande/MS. It is concluded that the war on drugs is aimed mainly against specific targets and the result of this is their mass imprisonment, acting based on criminal selectivity.

O Estado do Mato Grosso do Sul, uma vez que faz fronteira com os países Paraguai e Bolívia, torna-se um corredor de entorpecentes e, em decorrência disso, grande parte da população prisional sul-mato-grossense é formada por pessoas presas pela prática do delito de tráfico de drogas. O aprisionamento em massa oriundo do tráfico tem como alvo os mais vulnerabilizados socialmente, ou seja, os pobres, pretos e de baixa escolaridade. Nesse contexto, é importante entender a origem da proibição das substâncias entorpecentes e o momento histórico e social no qual estava e está inserido. Além disso, o estudo da criminologia se mostra necessário para entender as políticas criminais adotadas na guerra às drogas, com o auxílio da criminologia crítica e da teoria do etiquetamento. É imperiosa a discussão sobre os reflexos da Lei de Drogas no aprisionamento em massa em Campo Grande/MS e verificar os argumentos utilizados pelos magistrados em suas sentenças que contribuem para o aprisionamento dessas pessoas, utilizando conceitos do direito penal do inimigo e da guerra às drogas. Para atender essa finalidade, a pesquisa foi pautada no método hipotético-dedutivo, de forma descritiva e exploratória, com base no arcabouço da criminologia e na pesquisa bibliográfica, abarcando a legislação, pactos internacionais, artigos científicos, jurisprudência, dados fornecidos pelas agências nacionais de pesquisa sobre o sistema carcerário, além da pesquisa quali-quantitativa com análise dos processos de pessoas condenadas por esse crime que se encontram no Instituto Penal de Campo Grande/MS.
