This research seeks to analyze Article 334 of the Civil Procedure Code (CPC), which establishes the mandatory conciliation or mediation hearing as the initial stage of legal proceedings. This bibliographical research seeks to inform the purpose of this standard, the procedures involved and the implications for the parties involved. Furthermore, the principles that govern the act will be enumerated, as well as the impacts of the conciliation or mediation hearing on the search for consensual conflict resolution and the efficiency of the judicial system. In this way, the implication of the mandatory nature of this hearing is highlighted, where some Courts have not used consensual instruments. The methodological basis that permeates the entire present work and which is based on a bibliographical survey focusing on appropriate methods of conflict resolution, more precisely through the basis of books, articles and jurisprudence, in addition to the use of constitutional and infra-constitutional legislation, specialized doctrines and research published in scientific sources, thus aiming at CPC/2015 Law.
