Resumo: | The present work aims to analyze the repercussions of Resolution n. 487/2023 of the National Council of Justice (CNJ) for psychopaths undergoing security measures in the form of involuntary commitment. The specific objectives are to examine the characteristics of Antisocial Personality Disorder, its implications on culpability, and appropriate treatment measures within the scope of penal execution. The justification for this research lies in the significance of assessing the culpability of these individuals, as their capacity for culpability directly influences the state's response. It has been observed that psychopaths exhibit diminished culpability due to the traits associated with Antisocial Personality Disorder, which is why they are considered partially responsible, subject to either penalty or security measures, contingent on the necessity for specialized therapeutic intervention. However, it has been noted that the Brazilian penal system exhibits inadequacies in handling psychopathy and other mental disorders or illnesses. This is the reason why Resolution n. 487/2023 of the CNJ attempted to address this shortfall, instigating a deinstitutionalization of security measure enforcement under the scrutiny of the Judiciary, thereby transferring the responsibility of treatment and the guarantee of the right to mental health to the general healthcare system. This measure also presents inconveniences concerning the unique nature of Antisocial Personality Disorder. |

This measure also presents inconveniences concerning the unique nature of Antisocial Personality Disorder.O presente trabalho tem como objetivo geral analisar os reflexos da Resolução n. 487/2023 do CNJ para os psicopatas em cumprimento de medida de segurança na modalidade de internação e, como objetivos específicos, analisar as características do transtorno de personalidade antissocial, suas implicações na culpabilidade e medidas adequadas de tratamento, no âmbito da execução penal. A pesquisa realizada tem por justificativa a importância da análise da culpabilidade desses indivíduos, pois a capacidade de ser culpável reflete diretamente na resposta estatal. Verificou-se que os psicopatas possuem capacidade de culpabilidade diminuída, em razão das características provenientes do transtorno de personalidade antissocial, por isso, são considerados semi-imputáveis, sujeitos a pena ou medida de segurança, quando existir necessidade de especial tratamento curativo. No entanto, notou-se que o sistema penal brasileiro apresenta inadequações para lidar com a psicopatia e outros transtornos ou doenças mentais, razão pela qual a Resolução n. 487/2023 do CNJ tentou solucionar a defasagem, promovendo uma desinstitucionalização do cumprimento das medidas de segurança sob o crivo do Poder Judiciário, transferindo a responsabilidade do tratamento e a garantia do direito à saúde mental para o sistema geral de saúde, medida que também apresenta inconvenientes, no que diz respeito as singularidades do transtorno de personalidade antissocial.Fundação Universidade Federal de Mato Grosso do SulUFMSCiências SociaisCulpabilidade.
