Resumo: Prison allowance is a social security benefit intended for the dependents of the insured person imprisoned due to serving a sentence in the closed regime, causing economic instability for the family since he or she is the financial provider. Thus, during this imprisonment period, these dependents will have their basic needs met by the social security system. Changes in legislation have introduced new criteria for granting this benefit. From this point of view, this analysis seeks to assess the importance of the judiciary in recognizing this right facing the social security system.

Assim, durante esse período de retenção esses dependentes terão as suas necessidades básicas atendidas pelo regime previdenciário. Ocorre que as mudanças na legislação têm apresentado novos critérios para a concessão desse benefício.
