A judicialização da saúde no estado de Mato Grosso: análise da alteração da competência da 1ª Vara Especializada da Fazenda Pública da Comarca de Várzea Grande

This work presents an analysis of the change of competence of the 1st Specialized Court of the Public Treasury of the District of Várzea Grande, carried out by the Presidency of the Court of Justice of Mato Grosso. Observing its legitimacy to practice the Normative act, which led to the centralization of Right to Health actions in a single court, verifying the effectiveness through the analysis of data from the Court of Justice of the State of Mato Grosso. For this, both the deductive method was used, based on the study of laws and theories on the subject, as well as the qualitative method, as it is based on documentary research, in addition to making use of a quantitative approach, which took place through the analysis of data related to the processes that were processed in the 1st Specialized Court of the Public Treasury of Várzea Grande, from February to June 2022. The work was divided into three chapters, the first dealt with issues related to the topic in an introductory way, namely: health as a Right, from the perspective of Human Rights, Human Dignity and as a Fundamental Social Right, in addition to its Judicialization. The second chapter dealt with the change in the competence of the First Specialized Court of the Public Treasury of the District of Várzea Grande, through Resolution TJ-MT/OE No. 09 of July 25, 2019, analyzing the competence to legislate on the matter. The final chapter addressed the effectiveness caused by the changes in competences carried out, demonstrating through the analysis of graphs the legal consequences of the deed. In this way, it was concluded that the Specialization of the Public Treasury Court of the District of Várzea Grande in Health has proved to be beneficial for the effectiveness of the Right to Health in the State of Mato Grosso, given that it proved to be quantitatively efficient and with promising results.
