This undergraduated thesis focuses on the challenges faced by the women inside and outside of the criminal prosecution system. Through this perspective, we analyze what victimology is and what is its importance in the study of victims. We discuss the problem of male chauvinism and patriarchy in the blaming and revictimization of the victim, besides investigating the perspectives from both national and international documents as effective means for protecting women in situations of violence. Thus, we emphasize the importance of including a gender perspective in judicial decisions to oppose the neutral aspect of the judiciary in crimes in which women are victims of violence. We also address the State's duty to be concerned with issues related to gender violence as a guarantor of women's human rights. Finally, we reflect on domestic violence in the days of Covid-19 and what measures the authorities are taking to prevent the increase in cases of violence.
