Resumo: This academic work aims to identify the legal nature of the Botanical Gardens. Therefore, it talks, initially, about the emergence of an idea of environmental protection and the treatment given by the Constitution of 1988 to the environment. Further, notes the determination of the constituent in order to give the government a duty to create spaces to be specially protected, analyzes the Law n. 9.985/2000, which instituted the National System of Conservation Units. Not finding the Botanic Gardens listed in the list established by SNUG Act, which is ultimately, define its position as an atypical environment protected areas in view of its major importance for scientific research and documentation of floristic heritage of the country.

Para tanto, discorre-se, inicialmente, sobre o surgimento da ideia de proteção ambiental e o tratamento dado pela Constituição Federal de 1988 ao meio ambiente. Na sequência, constada a determinação do constituinte no sentido de atribuir ao Poder Público o dever de criar espaços a serem especialmente protegidos, analisa-se a Lei nº 9.985/2000, que instituiu o Sistema Nacional de Unidades de Conservação.
