A fishing expedition e seus reflexos no sistema democrático: o uso da investigação ampla e genérica como possível flerte com modelos autoritários

Resumo: The present work sought to analyze and understand what a fishing expedition is about and what its possible consequences in the criminal process and in practice. We tried to analyze whether this investigative “technique” would be in accordance with Brazilian law and with constitutional guaranteeing principles that govern criminal prosecution. For this, a research was carried out using both the deductive and inductive methods, in addition to the qualitative analysis of cases where the researched phenomenon was seen. In the first chapter, the foundations of the State, the process and the theory of evidence were analyzed; in the second, the origin of the phenomenon and questions of legality and understandings related to it were studied; the third, finally, dealt with Ferrajoli's theory of guaranteeism, authoritarian elements in the Brazilian system and cases related to thematic It was found that the use as fishing expeditions is not in accordance with both infraconstitutional laws and the Constitution, seeing in the phenomenon traces of authoritarian models. Models that can be fought with Luigi Ferrajoli's doctrine of penal Garantism.

Procurouse analisar se essa “técnica” investigativa estaria de acordo com a legislação brasileira e com os princípios constitucionais garantistas que regem a persecução penal. Para isso, foi realizada pesquisa aplicando tanto o método dedutivo quanto indutivo além da análise qualitativa de casos onde se enxergou o fenômeno pesquisado. No primeiro capítulo foi analisado os fundamentos do Estado, do processo e da teoria da prova; no segundo estudou-se a origem do fenômeno e questões de legalidade e entendimentos relacionados a este; o terceiro, por fim, tratou da teoria do garantismo de Ferrajoli, elementos autoritários no sistema brasileiro e casos ligados a temática.
