Resumo: ABSTRACT: The current research analyzes environmental justice with a focus on future generations. Environment protection for future generations is a justifiable mean to ensure environmental protection, under the risk of environmental resources depletion and unfeasibility of their balanced use for the generations to come. The study is constructed in three sections. The first chapter is intended to present the theory of environmental justice, explaining the concept of justice and environmental injustice, indicating the historical context and social cases that led the theory to emerge, and highlighting the main recipients of environmental justice. On the second part, the text is intended to identify who the future generations are, and presents the intergenerational equity theory and the principles formulated by Edith B. Weiss, as well as other specialized scholars. The following chapter indicates the main legal instruments that oversees intergenerational environmental protection and analyzes the feasibility of future generations being seen as rights holders. The third section is dedicated to discuss alternatives that can be implemented on the search for intergenerational environmental justice, asserting the feasibility of local and global environmental governance, as well as a paradigm shift consistent with the prevalence of an environmental ethic, and also on the adoption of international mechanisms such as the establishment of an international environmental Tribunal and the use of the DSD - Dispute System Design - to mediate environmental conflicts. The research was primarily bibliographical and documental, using qualitative and deductive approach on data analysis.

Der Umweltschutz für künftige Generationen ist, ein vertretbares Maß an Umweltschutz zu gewährleisten, vorbehaltlich der Erschöpfung der Umweltressourcen und die Unmöglichkeit für nachkommende Generation eine ausgewogene Umwelt zu kennen. Die Studie ist in drei Abschnitte gegliedert. Das erste Kapitel ist für die Darstellung der Theorie der Umweltgerechtigkeit. Es erklärt das Konzept der Gerechtigkeit und Ungerechtigkeit zum Thema Umwelt, Dieses Kapitel zeigt die Entstehung der Theorie mit dem Konzept der Gerechtigkeit gegenüber der Umwelt durch historischen Kontext und und Sozialfälle und wer die Empfänger der Umweltgerechtigkeit sind. Im zweiten Teil soll der Text identifizieren, wer die zukünftigen Generationen sind und stellt die Theorie der Generationengerechtigkeit und die von Edith B. Weiss formulierten Prinzipien, sowie andere spezialisierte Wissenschaftler und Wissenschaftlerinnen vor. Im Folgenden werden die wichtigsten Rechtsinstrumente, die generationsübergreifenden Umweltschutz sichern vorgestellt und die Realisierbarkeit zukünftiger Generationen als Rechteinhaber analysiert. Der dritte Abschnitt widmet sich der Suche nach generationsübergreifender Umweltgerechtigkeit,Forschung nach der Machbarkeit von Umweltpolitik in lokalen und globalen Regierungen, sowie einer Änderung in einem einheitlichen Paradigma in der Prävalenz von Umweltethik Prüfung. Dieser Abschnitt widmet sich auch der Annahme von internationalen Mechanismen der Bindungskraft, wie die Schaffung eines internationalen Umweltgerichtshofes und die Verwendung der DSD - Dispute System Design bei der Vermittlung von Umweltstreitigkeiten. Die Forschung war in erster Linie Literatur und Artikel, die einen qualitativen und deduktiven Ansatz zur Datenanalysemethode bedient.O presente estudo propõe-se a analisar a justiça ambiental para as futuras gerações. A proteção ambiental em favor das gerações vindouras é uma medida justificável para assegurar a proteção ambiental, sob pena de esgotamento dos recursos ambientais e inviabilidade do seu usufruto do meio ambiente equilibrado para as gerações que ainda estão por vir. O estudo está construído em três seções. O primeiro capítulo é destinado à apresentação da teoria da justiça ambiental, explicitando o conceito de justiça e injustiça ambiental, indicando o contexto histórico e casos sociais que impulsionaram o surgimento da teoria, e destacando os principais destinatários da justiça ambiental. Na segunda parte o texto se destina a identificar quem são as futuras gerações, e apresenta a teoria da equidade intergeracional e os princípios formulados por Edith B. Weiss, bem como de outros doutrinadores especializados. A seguir, indica os principais instrumentos legais que tutelam a proteção ambiental intergeracional e analisa a viabilidade de que as futuras gerações sejam vistas como titulares de direitos. A terceira seção se dedica a expor alternativas passíveis de implementação na busca por uma justiça ambiental intergeracional, verificando a viabilidade de uma governança ambiental local e global, bem como uma mudança de paradigma consistente na prevalência de uma ética ambiental, e ainda na adoção de mecanismos internacionais de força vinculativa, tais como a criação de um Tribunal internacional ambiental e o uso do DSD – Dispute Design System, na mediação de conflitos ambientais.
