Riscos ambientais laborais e proteção jurídica acidentária

Resumo: This study aims at worker´s legal protection against misfortunes at work within an interdisciplinary perspective, relating social security law with environmental law and sociology theories about the consequences of modern technology and the impacts of economic globalization upon environment and labor organization. The contingencies provided for labor insurance consist of the risks of accidents that workers are exposed at work by the professional enterprise. These labor risks are considered the main link between social security law and environmental law, considering that the prevention of accidents depend on law enforcement related to evaluation, control and management of risks. At the current stage of modernization and industrial development, these factors of risk are constantly changed by new technologies and division of labor technics associated to economic globalization process, contributing to increase workers´ vulnerability and, at the same time, governmental responsibility related to the management or regulation of insurance against labor accidents, according to article 201, § 10 of 1988 Brazilian Constitution. Due to this situation, the statistics of accidents at work represent high costs to the nation, which are financed by the whole society, in the social security system, based on the division of risks and social solidarity. In despite of some advances in public management of that insurance in Brazil, through the insertion of NTEP and FAP, the social security system still lacks of acting at risks prevention and joint work with Labor Inspectorate.

In despite of some advances in public management of that insurance in Brazil, through the insertion of NTEP and FAP, the social security system still lacks of acting at risks prevention and joint work with Labor Inspectorate.O presente estudo aborda a temática da proteção jurídica do trabalhador face aos infortúnios no trabalho dentro de uma perspectiva interdisciplinar, relacionando, principalmente, a matéria acidentária com o direito ambiental e com as contribuições teóricas da sociologia acerca das consequências da modernização tecnológica e dos impactos da globalização econômica sobre o meio ambiente e a organização do trabalho. As contingências abrangidas pelo seguro contra acidentes de trabalho são representadas pelos riscos de infortúnios, aos quais os trabalhadores são expostos pelo empregador no desempenho de sua atividade profissional. São esses riscos ambientais do trabalho que representam o principal elo entre a legislação acidentária e o direito ambiental, na medida em que a prevenção de acidentes passa necessariamente pelo cumprimento das normas ambientais do trabalho que estabelecem diretivas para avaliação, controle e gestão de riscos. No atual estágio de modernização e desenvolvimento industrial, esses fatores de risco são constantemente alterados pelas novas tecnologias e técnicas de divisão do trabalho associadas ao processo de globalização econômica, contribuindo para aumentar a vulnerabilidade dos trabalhadores e, no mesmo compasso, a responsabilidade do Estado frente à gestão ou regulação do sistema securitário, conforme previsto no art. 201, § 10, da CF/88. Os índices de acidentalidade representam um alto custo para o país, financiado por toda a sociedade através do seguro social, baseado na repartição de riscos, com fundamento na solidariedade social.
