Politics of Time in the Brazilian Supreme Court: ADPF 153, Amnesty Law and performative uses of History

Resumo: | This article approaches the relationship between history and justice using as a starting point the recent debate about the 1979 Amnesty Law at the Brazilian Supreme Court – at the occasion of judgment of the Arguição de Preceito Fundamental 153 in 2010. Considering the context of transitional justice and the changes in the historical discipline in the second half of the 20th century, particularly the discussions about time in history, the paper analyzes how the supreme justices manage the ‘politics of time’ in their votes. By observing the various temporal constructions that arise from the use of historical arguments, the article concludes that the supreme justices place the amnesty in the past and in the present, at the same time, to justify the impossibility of reinterpreting the law. The paper reflects upon the challenges of ‘making history’ in contexts where historical arguments and forms of historicization are operated by other political actors. |

El reciente debate sobre la Ley de Amnistía de 1979, específicamente la votación de la Arguição de Preceito Fundamental 153 en el Supremo Tribunal Federal (STF) en 2010, será el punto de partida de esta investigación. El trabajo primero analiza las prácticas de temporalización utilizadas por los ministros del STF y luego teje algunas relaciones con discusiones teóricas. Al observar las diversas construcciones temporales que surgen del uso de la historia y de las herramientas de historización, se observa que los ministros ubican la amnistía cerrada en el pasado y viva en el presente, al mismo tiempo, para justificar la imposibilidad de reinterpretar la ley.Este artigo visa abordar a relação entre história e justiça a partir do debate recente sobre a Lei da Anistia de 1979 na ocasião da Arguição de Preceito Fundamental 153 ajuizada pelo Supremo Tribunal Federal em 2010. Levando em consideração o contexto da justiça de transição e das mudanças na disciplina histórica na segunda metade do século XX, particularmente o fortalecimento das discussões sobre o tempo na história, o trabalho faz uma análise das práticas de temporalização utilizadas pelos ministros da corte. Ao observar as diversas construções temporais que surgem a partir da utilização da história e das ferramentas de historicização, se observa que os ministros situam a anistia encerrada no passado e viva no presente, ao mesmo tempo, para justificar a impossibilidade de reinterpretar a lei.
