A medida socieducativa de internação para adolescentes em conflito com a lei: uma análise a partir do Centro de Atendimento Socioeducativo

Resumo: This Master's Dissertation entitled THE SOCIOEDUCATIVE MEASURE OF INTERNAÇÃO PARA ADOLESCENTES IN CONFLICT WITH THE LAW: an analysis from the Center for Socio-Educational Assistance, is linked to the Post- Graduation Program in Social Service of the Federal University of Paraíba. It is an investigative study whose object is limited in the scope of the Protection Policy to the Child and Adolescent, and aims to analyze the effectiveness of the socio- educational measure of hospitalization for adolescents in conflict with the law. It is typified as a field survey with the adoption of quantitative-qualitative methodological procedures around a sample universe composed of 25 adolescents deprived of their liberty in the Center for Socio-Educational Assistance (CASE) in the municipality of Abreu e Lima / PE. This analysis is based on studies by authors theorists who study the themes that pervade the object of study, as well as legislation relevant to the area of childhood and youth. The discussions carried out in this work are based on the Marxist critical perspective, through the adoption of the materialist-historical and dialectical method by allowing the apprehension of the contradictions of capitalist society around the social processes in their totality. The results of this research indicate that the Neoliberal State, by reducing social expenditures to invest in the economic area, contributes to the establishment of a "Criminal State" that has as a characteristic the criminalization of poverty and mass incarceration, functioning as an instrument of the ruling class to possible threats to the established capitalist order. The results indicate the affirmation of the hypothesis of research that the advance of the neoliberal policies and the counter-reform of the State brought backs and difficulties to the pedagogical proposal of the National System of Socio-educational Assistance (SINASE), instituted in 2012. In conclusive terms, it is confirmed that the social problems experienced by adolescents in conflict with the law are criminalized and the mechanisms of confrontation have increasingly happened by a repressive State, therefore, away from the perspective of the guarantee of rights.

Trata-se de um estudo investigativo, cujo objeto circunscreve-se no âmbito da Política de Proteção à Criança e ao Adolescente, e, objetiva a analisar a efetividade da medida socioeducativa de internação para adolescentes em conflito com a lei. Tipifica-se como pesquisa de campo com adoção de procedimentos metodológicos quanti-qualitativos em torno de um universo amostral composto por 25 adolescentes privados de liberdade internos no Centro de Atendimento Socioeducativo (CASE) do município de Abreu e Lima/PE. Essa análise embasa-se em estudos de teóricos de autores que estudam as temáticas que perpassam o objeto de estudo, bem como em legislações pertinentes à área da infância e juventude. As discussões realizadas neste trabalho fundamentam- se na perspectiva crítica marxista, mediante a adoção do método materialista- histórico e dialético por permitir a apreensão das contradições da sociedade capitalista em torno dos processos sociais em sua totalidade. Os resultados desta pesquisa apontam que o Estado Neoliberal ao reduzir gastos sociais para investir na área econômica, contribui para o estabelecimento de um “Estado Penal” que tem como característica a criminalização da pobreza e o encarceramento em massa, funcionando como instrumento da classe dominante para controlar as possíveis ameaças à ordem capitalista estabelecida. Os resultados indicam a afirmação da hipótese de pesquisa de que o avanço das políticas neoliberais e a contrarreforma do Estado trouxeram retrocessos e dificuldades à proposta pedagógica do Sistema Nacional de Atendimento Socioeducativo (SINASE), instituído em 2012.
