Processo judicial eletrônico: uma avaliação através do Common Assessment Framework

Resumo: | This research aimed to evaluate the System of Electronic Judicial Process (PJe) in the scope of the Court of Justice of the State of Paraíba (TJPB), through the evaluation tool known as Common Assessment Framework (CAF), which consists of a Quality Management Model Total that was developed for use in the European Public Sector, whose inspiration resides in the Model of Excellence of the European Foundation for the Quality Management. The PJe emerged in the midst of a developmental situation of society and a wave of renewal that culminated in the virtualization of the processes within the judiciary, aiming at the faster, effective judicial provision with respect to environmental sustainability and economics of Resources, in addition to the interoperability of actions between the courts. In view of the purposes for which the system was created, as well as the wide scope and importance it holds before the Brazilian Justice, it was necessary to analyze whether the System of the PJe has complied with the general guidelines that justified its implementation. As a theoretical reference, the work was based on the principles that should guide the judicial process, as in the CAF Model, which deals with Total Quality Management and seeks to promote learning and continuous improvement actions in order to achieve organizational excellence. The research is classified as exploratory, and, in terms of means of investigation, it is classified as field research. As a temporal cutout, the evaluation was limited to the period from which the system was implanted in civil courts of João Pessoa, that is, from the Month of May 2015. The data collection was done through closed questionnaires applied to the research sample, which was defined as being from eighteen civil servants from nine civil courts of João Pessoa, randomly chosen from among the seventeen existing courts, and eighteen lawyers with lawsuits in the respective judicial units. In addition, the questionnaire elaboration observed the staggered method of Type Likert, and for the treatment of the data statistical techniques were used. Likewise, to help analyze the collected data, the scoring panels of the CAF's classic scoring system were used, from which it was possible to identify the stage in which a particular theme is found and indicate improvements to be undertaken in the subjects that presented low punctuation. In addition, it was verified, with respect to the general guidelines that justified the appearance of the PJe, that these are met in general, however, the lack of interest of the institution in promoting courses of improvement specifically on the PJe and listening to the servers about of the difficulties faced with the use of the system, presented themselves as obstacles to greater procedural speed. Beside, it has become clear that the standardization of judicial acts has not been sought as a way of promoting the uniformity of the Judiciary, and the organization is not provided with the necessary structure to serve the most needy population, which restricts the access of these people to justice, and, consequently, becoming a barrier to greater jurisdictional effectiveness. |

O PJe surgiu em meio a uma conjuntura de desenvolvimento da sociedade e de uma onda de renovação que culminou na virtualização dos processos dentro do Poder Judiciário, visando a prestação jurisdicional mais rápida, efetiva, com respeito à sustentabilidade ambiental e economia de recursos, além da interoperabilidade das ações entre os tribunais. Diante das finalidades para as quais o sistema foi criado, bem como a ampla abrangência e importância que ele detém perante a Justiça Brasileira, viu-se a necessidade de analisar se o Sistema do PJe tem atendido as diretrizes gerais que justificaram sua implantação. Como referencial teórico, o trabalho fundamentou-se nos princípios que devem nortear o processo judicial, assim como no Modelo CAF, que trata da Gestão da Qualidade Total e busca promover aprendizagem e ações de melhoria contínuas no intuito de alcançar a excelência organizacional. A pesquisa é classificada como exploratória, e, quanto aos meios de investigação, classifica-se como pesquisa de campo. Como recorte temporal, a avaliação se limitou ao período a partir do qual o sistema foi implantado nas varas cíveis de João Pessoa, ou seja, desde o mês de maio de 2015. A coleta de dados foi feita através de questionários fechados aplicados à amostra da pesquisa, que foi definida como sendo de dezoito servidores de nove varas cíveis de João Pessoa, escolhidas aleatoriamente dentre as dezessete varas existentes, e dezoito advogados com demandas nas respectivas unidades judiciárias. Além disso, a elaboração dos questionários observou o método escalonado do Tipo Likert, e para o tratamento dos dados foram usadas técnicas estatísticas. Outrossim, para auxiliar na análise dos dados colhidos, foram utilizados os painéis de pontuação do sistema de pontuação clássica da CAF, a partir dos quais foi possível apontar o estágio em que se encontra determinado tema e indicar melhorias a serem empreendidas nas temáticas que apresentaram baixa pontuação. Ademais, verificou-se, com relação às diretrizes gerais que justificaram o surgimento do PJe, que estas são atendidas de um modo geral, porém, a falta de interesse da instituição em promover cursos de aperfeiçoamento especificamente sobre o PJe e em ouvir os servidores acerca das dificuldades enfrentadas com o uso do sistema, se apresentaram como entraves para uma maior celeridade processual.
