O deslocamento e julgamento de decisões políticas pelo Supremo Tribunal Federal: uma análise empírica das ações diretas de inconstitucionalidade entre 2010 e 2019

Resumo: | Since the re-democratization, the Brazilian Supreme Federal Court (STF), has assumed remarkable institutional roles foreseen in the Federal Constitution from 1988. Over time, the Supreme Court's decisions started to have greater repercussions on the political scene. Many studies in the field of political science have been developed with the aim of understanding how institutions in Brazilian constitutional democracy are related. To this end, the Supreme Court has become an institution widely used by national literature in political analysis, with a special focus on the form and frequency that political agents call the Court and how it judges actions that make up the Brazilian Institute for Concentrated Control of Abstract Constitutionality, highlighting Direct Actions of Unconstitutionality (ADIs). The actions that make up concentrated control directly interfere in national political life, as they allow the maintenance and even exclusion of legislative norms and governmental acts from the Brazilian democratic system. In the analysis of these actions, some authors have argued that the STF has acted with restraint in deciding actions of political impact. Other studies, however, have pointed out that institutes internal to the Supreme Court allow individual ministers to act to impact political decisions. The present work has the following problem: what is the pattern of displacement and judgment of political decisions by the STF, in the context of ADIs, between the years 2010 and 2019? ADIs are adopted as an analysis variable because they allow the removal of norms of the legal democratic order, and also because they make up the majority of concentrated constitutionality control actions in the period considered. Descriptive in character, the present work adopts as instruments of descriptive statistics the measures of central tendency (mean and median), the measure of dispersion (standard deviation), and the measure of position (relative frequency distribution), in order to understand the problematized phenomenon. From the survey of data on the ADIs assessed and decided, the interpretations on the displacement and the judgment of political decisions by the STF are studied. With the analysis of the pattern of displacement and judgment, the objective is to understand how the Supreme Court processed and judged the ADIs, between 2010 and 2019, studying how the literature has interpreted the Court's performance, and discussing whether there was a restrained performance Court in the period considered. The analysis of data and literature seems to suggest that, in the context of ADIs, between 2010 and 2019, the STF attributed mostly final decisions to the processes filed by governors and associations in matters of administrative law, interfering more in state organizational matters and associations than federal, partisan and confederative issues. Furthermore, most of the final decisions were collegiate and did not assess the merits of the actions. The STF acted with restraint. Still, the demonstration that most internal decisions in the ADI processes were monocratic, and that ministers use internal institutes to promote political impact, may suggest a huge power of ministers, individually. In this sense, the ministers, individually, were not restrained in their performance. |

Com o tempo, as decisões da Suprema Corte passaram a ter maior repercussão no cenário político. Muitos estudos na área de ciência política têm sido desenvolvidos tendo por objeto compreender como as instituições na democracia constitucional brasileira se relacionam. Para isso, o Supremo passou a ser uma instituição amplamente utilizada pela literatura nacional em análises políticas, tendo por especial enfoque a forma e a frequência que os agentes políticos acionam o Tribunal e como este julga ações que compõem o instituto do Controle Concentrado de Constitucionalidade abstrato, destacando-se as Ações Diretas de Inconstitucionalidade (ADIs). As ações que compõem o controle concentrado interferem diretamente na vida política nacional, por permitirem a manutenção e até exclusão de normas legislativas e atos governamentais do sistema democrático brasileiro. Na análise dessas ações, alguns autores têm defendido que o STF tem agido de forma comedida em decidir ações de impacto político. Outros estudos, porém, têm apontado que institutos internos ao Supremo possibilitam que os ministros individualmente atuem no sentido de impactar decisões políticas. O presente trabalho tem o seguinte problema: qual o padrão de deslocamento e de julgamento de decisões políticas pelo STF, em sede de ADIs, entre os anos de 2010 e 2019? As ADIs são adotadas como variável de análise por possibilitarem a retirada do ordenamento jurídico de decisões democráticas, e também por comporem a maioria das ações de controle concentrado de constitucionalidade no período considerado. De caráter descritivo, o presente trabalho adota como instrumentos de estatística descritiva as medidas de tendência central (média e mediana), a medida de dispersão (desvio padrão), e a medida de posição (distribuição de frequência relativa), a fim de se compreender o fenômeno problematizado. A partir do levantamento dos dados sobre as ADIs autuadas e decididas, passa-se a estudar as interpretações sobre o deslocamento e o julgamento de decisões políticas pelo STF. Com a análise do padrão de deslocamento e julgamento, objetiva-se compreender como o Supremo processou e julgou as ADIs, entre 2010 e 2019, estudando-se como a literatura tem interpretado a atuação da Corte, e discutindo-se se houve uma atuação comedida da Corte no período considerado. A análise dos dados e da literatura parece sugerir que, em sede de ADIs, entre 2010 e 2019, o STF atribuiu decisões finais, em sua maioria, aos processos protocolados pelos governadores e associações em matéria de direito administrativo, interferindo mais em assuntos organizacionais estaduais e associativos do que federais, partidários e confederativos. Ademais, a maioria das decisões finais foi colegiada e não avaliou o mérito das ações. O STF atuou de forma comedida. Ainda assim, a demonstração de que a maioria das decisões internas aos processos de ADIs foi monocrática, e de que os ministros se utilizam de institutos internos para promover impacto político, podem sugerir um amplo poder dos ministros, individualmente.
