TERRITORIES IN DISPUTE: CONFLICTS FOR THE POSSESSION AND USE OF LAND IN THE VILLAGE OF NOSSA SENHORA DOS REMÉDIOS

RESUMO: Este artigo discorre sobre a formação e a dinâmica de um aldeamento de índios Gueren na Barra do Rio de Contas (território da antiga capitania de Ilhéus, na costa da Bahia, atual cidade de Itacaré), na primeira metade do século XVIII. O estudo se fará na perspectiva do direito a terra e dos conflitos concernentes aos diferentes interesses de índios, colonos arrendatários de terras e missionários representantes do colégio da Bahia, detentor legítimo da sesmaria do Camamu, onde se inseria o aldeamento e a vila. As principais fontes são um conjunto de documentos referentes aos conflitos de terras ocorridos naquele território, a partir do qual se identificou os atores sociais, suas demandas e suas justificativas, ancoradas que estavam no direito e nos costumes sobre a posse e a propriedade da terra no Império Luso, considerando, ainda, a legislação indigenista e sua aplicação na resolução de conflitos desta natureza.ABSTRACT: This articule discusses the formation and dynamics of na Indian village Gueren in Barra do Rio de Contas (territory of the former captaincy of Ilhéus, the coast of Bahia, current city of Itacaré), in the first half of the 18 century. The study will be done from the perspective of the right land and conflicts related to the diferente interests of indians, sttlers, and missionaries tenants representatives of the College of Bahia, legitimate holder allotment of Camamu, where ir formed part of the village and the villege. The main sources are a set of documents related to lansd conflicts occurring on that territory, from which identified the socila actors, their demands and their justifications, anchored in the law and custos on possession and owner ship of the land in the portuguese.
