Essa difusão também gerou diversas matizes dessa disciplina e em cada local podemos encontrar uma vertente diferente, com fundamentos, pontos de partida e conclusões diferenciadas. O presente trabalho se debruça sobre um dos autores desse movimento, provavelmente um dos fundadores dessa corrente teórica, junto com Gary Becker: Richard Posner. Considerando o ideal de Posner de trazer mais cientificidade ao direito e uma maior capacidade de previsibilidade, assim como uma aproximação com algumas ciências mais hard, utilizando dados estatísticos, métodos qualitativos e quantitativos, fazemos uso da teoria epistemológica de Thomas Khun para usar como lente no nosso trabalho. A obra de Kuhn é aplicada ao Direito e nos ajuda a entender como ocorreu uma das guinadas mais significativas da corrente do law and economics. O cenário aqui é a crise econômica de 2008. Posner recebeu a crise com espanto e isso pode ser notado em suas obras próximas ao evento, abalando todo seu arcabouço filosófico. Com a crise, Posner não apenas questiona as bases fundamentais do law and economics, mas também a base das democracias ocidentais. Investigamos o que gerou essa guinada no pensamento do jurista americano. Posner muda ideologicamente, abandonando um liberalismo mais ligado à escola austríaca, como também metodologicamente, defendendo a aproximação do direito das ciências mais duras e de métodos mais precisos.CAPESThe law and economics has flourished in recent years, breaking the boundaries and spreading steadily throughout the world. This diffusion also generated several nuances of this discipline and in each place we can find a different strand, with foundations, starting points and differentiated conclusions. The present work focuses on one of the authors of this movement, probably one of the founders of this theoretical current, along with Gary Becker: Richard Posner. Considering Posner's ideal of bringing more scientificity to law and a greater capacity for predictability, as well as an approximation to some harder sciences, using statistical data, qualitative and quantitative methods, we make use of Thomas Khun's epistemological theory to use as a lens in our work. Kuhn's work is applied to law and helps us understand how one of the most significant trends in law and economics has occurred. The scenario here is the economic crisis of 2008. Posner received the crisis with astonishment and this can be noticed in his works close to the event, shaking all his philosophical framework. With the crisis, Posner not only questions the fundamental foundations of law and economics, but also the basis of Western democracies. We investigated what generated this turn in the thought of the American jurist.
