Esta tese examina o comportamento decisório do CNJ entre 2005 a 2015, averiguando se a agência foi capturada pela magistratura. Em particular, testou-se a hipótese geral de que a relatoria pertencente ao grupo “Indicado por órgão do Judiciário” (magistrado) sofre menos divergência do que a relatoria do grupo “Indicado por órgão essenciais à justiça” (cidadão de notável saber jurídico e reputação ilibada, advogado, membro do Ministério Público). Examinam-se, ainda, as seguintes hipóteses específicas concernentes aos processos relatados por “Indicado por órgão do Judiciário”: 1) a manutenção do voto desse tipo de relator em decisão final é maior; 2) possuem menor chance de serem acometidos de pedido de vista; 3) são mais céleres. O desenho de pesquisa combina análise documental, estatística descritiva e inferencial (qui-quadrado e análise de sobrevivência) para examinar um banco de dado original que compila quase a totalidade dos dados de interesse do plenário do CNJ entre 2005 e 2015. Os resultados apontam que: I) todas as hipóteses (geral e específicas) não foram confirmadas, visto que, ao contrário do esperado, a maior ocorrência proporcional em todos os casos e a menor celeridade são na relatoria do grupo “Indicado por órgão do Judiciário”. Buscando aprofundar os achados, desagregaram-se os dois grupos de referência em três subgrupos (“Indicado por órgão do Judiciário - acesso direto”, “Indicado por órgão do Judiciário - acesso pelo terço, quinto ou STF” e “Indicado por órgão essencial à Justiça”) e a reaplicação dos testes apontam: II) a diferença de comportamento é significativa para a hipótese geral, primeira e segunda hipóteses específicas quando testam os três subgrupos, com maior percentual de ocorrência descritiva nesses casos para o “Indicado por órgão do Judiciário – acesso direto”; III) o comportamento do “Indicado por órgão do Judiciário – acesso direto” é de maior dissenso/não coesão em relação aos demais no que se refere à divergência e à derrota do voto do relator, os outros dois subgrupos, por sua vez, possuem comportamentos semelhantes/agrupados; IV) processos relatados por “Indicado por órgão do Judiciário - acesso pelo terço, quinto ou STF” são mais céleres e possuem um comportamento significativamente diferente dos demais. Conclui-se que a cúpula do Judiciário não capturou a agência na perspectiva decisória analisada, bem como denotou-se que as variáveis testadas são melhores explicadas pelo modelo institucionais (certa aversão à divergência e similaridade entre comportamento de determinados subgrupos), estratégicos e racionais subótimos (viés estratégico não sofisticado em termos coletivos pois o interesse individual ou fragmentado do magistrado sobrepõe ao interesse corporativo coletivo da categoria). A presente tese preenche uma lacuna na agenda de pesquisa que trata dos conselhos judiciais, contribuindo na compreensão do processo decisório do CNJ.To the magistrate, everything? This thesis examines the CNJ's decision-making process between 2005 and 2015, seeking to ascertain whether the agency has been captured by the Judiciary. In particular, the general hypothesis tested was that the report belonging to the group “Indicated by organ of the Judiciary” (magistrate) suffers less divergence than the report of the group “Indicated by essential organs to the Justice” (citizen of notable juridical knowledge and unblemished reputation, lawyer, member of the Public Attorney’s Office). It was also examined the following specific hypothesis about the reported proceedings by “Indicated by organ of the Judiciary”: 1) the maintenance of the vote of this kind of rapporteur in the final decision is higher; 2) they have less chance of being asked to be seen; 3) they are faster. The research design combines documental analysis, descriptive statistics and inferential (chi-square and survivor analysis) to examine an original data bank, which compiles almost the totality of the data of interest of the plenary of CNJ between 2005 and 2015. The results point that: I) all of the hypothesis (general and specifics) were not confirmed, since, contrary to expectations, the higher proportional occurrence in all the cases and the less speed are in the rapporteur of the group “Indicated by organ of Judiciary”. Searching to deepen the findings, the two reference groups were disintegrated in three subgroups (“Indicated by organ of Judiciary – direct access”, “Indicated by organ of Judiciary – access by third, fifth or STF” and “Indicated by essential organ to the Justice”) and the reapplication of the tests pointed that: II) the difference of behavior is meaningful to the general hypothesis, the first and second specific hypothesis when the three subgroups are tested, with higher percentage of descriptive occurrence in these cases to the “Indicated by organ of Judiciary – direct access”; III) the behavior of “Indicated by organ of Judiciary – direct access” has a higher discordance/non cohesion in relation to the others in what refers to the divergence and to the defeat in the vote of the rapporteur, the other two groups, in the other hand, have similar/grouped behaviors; IV) proceedings reported by “Indicated by organ of Judiciary – access by third, fifth or STF” are the fastest and have a behavior meaningfully different from the others. It was concluded that the summit of Judiciary did not captured the agency in the perspective decision-making analyzed, as well as it was denoted that the variables tested are better explained by the institutional model (certain aversion to the divergence and similarity between behavior of determined subgroups), strategic and rational suboptimal (unsophisticated strategic bias in collective terms because the individual or fragmented interest of the magistrate overlaps to the collective corporative interest of the category).
