Tal conceito faz referência à procura do Judiciário para aquisição dos produtos e serviços de Saúde demandados e negados pelo SUS, seja por falta de previsão na RENAME, ou por ações orçamentárias escassas. É possível estabelecer que a judicialização atende, precipuamente, às necessidades individuais em detrimento das coletivas. Grosso modo, a desorganização da política de saúde e os recorrentes gastos dos recursos públicos ferem coletivamente a igualdade de acesso à Saúde Pública. Em contrapartida, a judicialização pode contribuir com avanços nas políticas públicas de Saúde, haja vista que as ações judiciais aceleram o processo de incorporação das novas tecnologias. Ademais, procurou-se categorizar os gastos da assistência à Saúde para cumprimento das ações judiciais, estimando os gastos de medicamentos incorporados e não incorporados. Como resultado, os dados apontaram obstáculos ao planejamento e à gestão do orçamento público, dada a imprevisibilidade dos custos imposto pelas ações judiciais. O estudo envolveu pesquisa documental, descritiva e retrospectiva. A coleta dos dados foi obtida por meio de bancos de dados do Núcleo de Ações Judiciais (NAJ-SES-PE) e, através do levantamento no sistema da rede compras de Pernambuco. Apresenta-se, ainda, uma estimativa dos gastos inerentes a medicamentos, insumos, alimentos e descartáveis. As expensas chegaram a um total de R$ 18.675.403,07 (dezoito milhões seiscentos e setenta e cinco mil quatrocentos e três reais e sete centavos).The present study categorizes health care expenditures to comply with lawsuits, estimating the expenses of incorporated and unincorporated drugs. It is possible to affirm that the judicialization serves to, mainly, the individual needs to the detriment of the collective ones. Roughly, the disorganization of health policy and the recurrent expenditure of public resources collectively hurt the equal access to Public Health. On the other hand, the judicialization can contribute with advances in the public Health policies, since judicial actions accelerate the process of incorporation of the new technologies. In addition, we categorized health care expenditures to comply with lawsuits, estimating the expenses of drugs incorporated and not incorporated. As a result, the data posed obstacles to the planning and management of the public budget, according to the unpredictability of the costs imposed by the lawsuits. The judicialization in health refers to the demand of the judiciary for the acquisition of health products and services demanded and denied by the SUS, either due to lack of foresight in RENAME, or by scarce budgetary actions, becoming transparency of a deficient health system. The study involved documentary, descriptive and retrospective research. The data collection was obtained by secondary banks of the judicial actions nucleus (NAJ-SES-PE), and the survey in the system of the shopping network of Pernambuco.
