Para tanto, analisam-se as instituições formais e informais presentes no fenômeno social, por meio da observação do comportamento dos atores, detalhando suas ações, interações, interesses, escolhas e preferências. Ainda, pretende-se expor as relações causais existentes no seu processo de formação, penetrando nos fatores contextuais que influenciaram sua existência. Utilizam-se para nossa análise o Inquérito Policial n.º 2.245/MG, a Denúncia oferecida pelo Ministério Público Federal e o Acórdão proferido pelo Supremo Tribunal Federal na Ação Penal n.º 470. Por fim, exibe-se o gap teórico que se considera existir na literatura sobre o presidencialismo de coalizão, tese que não foi capaz de explicar o surgimento deste fenômeno social. Para executar tais pretensões, referencia-se na teoria neoinstitucional em suas versões do institucionalismo histórico, da escolha racional e das instituições informais. Guia-se por uma lógica antifundacionista, predominantemente interpretativa e descritiva, instrumentalizada em uma metodologia de estudo de caso, de explicação por mecanismos e de narrativa analítica, através de técnicas de coletas e análise de dados qualitativos. Com isso, conseguiu-se realizar a trajetória histórica e a análise dos mecanismos existentes na Ação Penal n.º 470, compreendendo os arranjos formais e informais presentes na dinâmica, além de seus reflexos nos resultados políticos e no funcionamento das instituições. Verificou-se que as ações denunciadas na Ação Penal n.º 470 constituíram uma instituição informal substitutiva, a qual coexiste com as instituições formais e, apesar de violar as regras, alcançam resultados com elas compatíveis. Ainda, verificamos uma lacuna teórica na teoria do presidencialismo de coalizão, por não considerar as instituições informais em sua análise, responsáveis, juntamente às instituições formais, por fenômenos sociais como o Mensalão.CAPESThis work aims to analyze, understand and explain the present mechanisms in the Ação Penal n.º 470, popularly known as “Mensalão”. To do so, we intend to analyze the formal and informal institutions in the social phenomenon, by observing the behavior of the actors, detailing their actions, interactions, interests, choices and preferences. Still, we intend to expose the existing causal relationships in the formation process, penetrating the contextual factors that influenced their existence. For our analysis, we will use the Inquérito Policial n.º 2.245/MG, the complaint offered by the Ministério Público Federal and the judgment given by the Supremo Tribunal Federal in the Ação Penal n.º 470. Finally, we intend to show the theoretical gap that we consider to exist in the literature of presidencialismo de coalizão, a thesis that was not capable to explain the emergence of this social phenomenon. To carry out such pretensions, we refer to neoinstitutional theory in its versions of historical institutionalism, rational choice and informal institutions. We are guided by an anti-foundational logic, predominantly interpretative and descriptive, instrumented in a methodology of case study, explanation by mechanisms and analytical narrative, through techniques of collection and analysis of qualitative data. With this, we were able to carry out the historical trajectory and the analysis of the existing mechanisms in Ação Penal n.º 470, including the formal and informal arrangements present in the dynamics, as well as their impact on the political results and the functioning of institutions. We have found that the actions denounced in Ação Penal nº 470 constituted an informal substitute institution, which coexists with formal institutions and, despite violating the rules, achieve results compatible with them.
