NOTES ON THE NORMATIVE FRAMEWORKS OF LAW EDUCATION IN BRAZIL AND ITS RELATION TO THE MARKET ECONOMY: FROM THE BRAZILIAN EMPIRE TO 21ST CENTURY

Resumo: | Legal courses were created in Brazil in 1827 and, since then, the rules governing the teaching of Law have changed in order to better adapt it to the political, economic and social scenario. Access to higher education, especially Law, has not always been democratic, having initially been offered only to the elite. It was only with the 1988 Constitution that public policies for the universalization of access to education received prominence. Thus, the problem to which this research was dedicated was to understand what possible relationship exists between the teaching of law in Brazil, from the understanding of its normative frameworks from the Empire to the 21st century, and the market economy. The general objective was to relate the teaching of law with the market economy. For the development of the research three specific objectives were established: to identify the main normative alterations that had an impact on legal education in Brazil; to establish a critical analysis of the legislative changes and their impacts on the teaching of Law; and, finally, to reflect on the impacts of the regulation of the Law course on the market economy. The hypothesis suggested is that the market economy can influence the teaching of Law with regard to professional direction, the offer of courses and the expansion of access to education. The methodology used for the development of the research was the inductive method, and for the development of each stage, the historical and monographic methods were chosen. |

Los cursos jurídicos fueron creados en Brasil en 1827 y, desde entonces, las normas que rigen la enseñanza del Derecho han sufrido cambios para adaptarla mejor al escenario político, económico y social. El acceso a la educación superior, especialmente en Derecho, no siempre ha sido democrático, y al principio sólo estaba al alcance de la élite. Sólo con la Constitución de 1988 se destacaron las políticas públicas de acceso universal a la educación. Así, el problema al que se dedicó esta investigación fue entender qué relación posible existe entre la enseñanza del Derecho en Brasil, desde la comprensión de sus marcos normativos desde el Imperio hasta el siglo XXI, y la economía de mercado. El objetivo general era relacionar la enseñanza del derecho con la economía de mercado. Se establecieron tres objetivos específicos para el desarrollo de las etapas de la investigación: identificar las principales alteraciones normativas que tuvieron impacto en la enseñanza del Derecho en Brasil; establecer un análisis crítico de los cambios legislativos y su impacto en la enseñanza del Derecho; y, finalmente, reflexionar sobre el impacto de la regulación del curso de Derecho en la economía de mercado. La hipótesis sugerida es que la economía de mercado puede influir en la enseñanza del Derecho en lo que respecta a la dirección profesional, la oferta de cursos y la ampliación del acceso a la educación. La metodología utilizada para el desarrollo de la investigación fue el método inductivo y, para el desarrollo de cada etapa, se eligieron los métodos histórico y monográfico.Os cursos jurídicos foram criados no Brasil em 1827 e, desde então, as normas que regem o ensino do Direito têm sofrido alterações com o intuito de melhor adequá-lo ao cenário político, econômico e social. O acesso ao ensino superior, em especial ao Direito, nem sempre foi democrático, tendo de início se prestado apenas às elites. Foi somente com a Constituição de 1988 que as políticas públicas de universalização do acesso à educação receberam destaque. Desse modo, o problema ao qual se dedicou a presente pesquisa foi compreender qual a possível relação existente entre o ensino do direito no Brasil, a partir da compreensão de seus marcos normativos desde o Império até o século XXI, com a economia de mercado. O objetivo geral consistiu em relacionar o ensino do direito com a economia de mercado. Para o desenvolvimento das etapas de pesquisa foram estabelecidos três objetivos específicos: identificar as principais alterações normativas que impactaram no ensino jurídico no Brasil; estabelecer uma análise crítica das mudanças legislativas e de seus impactos no ensino do Direito; e, por fim, refletir sobre os impactos da regulamentação do curso de Direito para a economia de mercado. A hipótese sugerida é de que a economia de mercado pode influenciar no ensino do Direito no que concerne ao direcionamento profissional, à oferta de cursos e à expansão do acesso ao ensino.
