Resumo: O presente trabalhou buscou demonstrar, de forma inicial, a legislação e as principais orientações do Ministério da Saúde no que se refere à Atenção Domiciliar em Saúde e inserção da Odontologia nesse tipo de cuidado em saúde. Os autores entendem que existem leis assegurando, porém não existe uma determinação e orientação clara nas publicações do Ministério da Saúde sobre a as possibilidades de assistência odontológica no ambiente domiciliar.
