O artigo pretende apontar alguns elementos do processo de constituição do Estado moderno, entre os quais a noção de soberania, nos séculos finais do medievo. Essa nova realidade, que não se configurou ao mesmo tempo nem por um processo único em toda a Europa, apresentou algumas características comuns. Procura-se argumentar que os conflitos entre os vários atores envolvidos nesse processo foram, simultaneamente, de natureza política e jurídica, e que nessa discussão construíram-se os alicerces legais e ideológicos do poder do Estado, ao mesmo tempo em que se determinou sua extensão. ON ROUTE TO THE MODERN STATE: THE MEDIEVAL ROOTS OF SOME OF ITS FORMATIVE ELEMENTS Abstract This article points to some key elements in the process of the building of the modern State at the end of the medieval period, among which we find the notion of sovereignty. This new reality, which did not take shape at the same moment nor through only one type of process throughout all of Europe, did however develop some common characteristics. We argue that the conflicts between the various actors involved in this process were, simultaneously, of political and juridical nature, and that through them the legal and ideological pillars of State power were built, at the same time determining its scope. VERS L’ETAT MODERNE: LES RACINES MEDIEVALES DE CERTAINS DE SES ELEMENTS FORMATEURS Résumé L’article entend identifier des éléments du processus de constitution de l’Etat moderne, parmi lesquels la notion de souveraineté dans les derniers siècles moyenâgeux. Cette nouvelle réalité qui ne s’est pas dessinée en même temps ni par un processus unique dans toute l’Europe, a présenté quelques caractéristiques communes. Dans ce travail, nous argumentons que les conflits entre les divers acteurs concernés par ce processus ont été à la fois de nature politique et juridique et que dans ce débat les bases légaux et idéologiques du pouvoir de l’Etat ont été dressées pendant que son ampleur est fixée.
