A participação popular na avaliação de impacto ambiental: um olhar democrático para a proteção ambiental

The objective of this study is to analyze the effective participatory democracy within the scope of the environmental impact assessment procedure. The principle of popular participation in environmental matters is diametrically rooted in the foundations of the Democratic State of Law. It is an unassailable premise at the constitutional level that civil society should be given suitable spaces for effective public participation in environmental matters. For the occurrence of an effective participation the development of the principle of information and environmental education is an irrefutable axiom. For this purpose, a juridical-theoretical approach and a deductive reasoning with a bibliographic research technique were used in this research. At the end of the research, it can be evidenced that in Brazil the spaces offered for the realization of the constitutional principle of popular participation, regarding the procedure of environmental impact assessment, are still limited in the national scenario. It is necessary to develop the principles of information and environmental education to enable effective participation of the people. The fundamental right to the environment must be promoted to the maximum, and for that, its social actors must be imbued with concrete and effective participation.
