É verbo transitivo, como em trânsito se achava a cultura jurídica da segunda metade do século XIX. O presente trabalho toma por objetos a construção e a circularidade dessa cultura em torno de um ponto específico: a experiência - vivida ou almejada - de liberdade nas malhas da escravidão brasileira. Sua proposta central é refletir sobre as lutas jurídicas escravas a partir da diversidade tanto de atores nelas implicados - fossem eles operadores do direito propriamente (curadores, advogados, magistrados, amanuenses) ou leigos (depositários, avaliadores, testemunhas, partes, etc.) -, quanto de discursos nelas veiculados (legislativos, doutrinários, jurisprudenciais, morais, políticos, econômicos, etc.). Trata-se de acompanhar a emergência de um campo jurídico nacional profundamente marcado por contradições e ambigüidades, mediador entre o "favor à liberdade" e o "direito de propriedade", no fio da navalha entre o império da lei e o domínio dos patriarcas. Costurando saberes populares e eruditos, o direito atou o nó no pescoço de muitos senhores. Em meio a esse emaranhado de projetos, leituras e vozes dissonantes, é possível desnaturalizar o lugar coisificado convencionalmente reservado aos cativos, recuperando tradições jurídicas também enquanto parte da tradição dos oprimidos. Para tanto, é preciso abandonar o olhar mecanicista muitas vezes lançado sobre o direito, colocando em evidência o jogo de interpretações, a disputa de sentidos e conteúdos que, palmo a palmo, foi moldando a cultura político-jurídica oitocentista, minando os pressupostos materiais e simbólicos do cativeiro e politizando os tribunais como espaços de resistência negra. Nesse sentido, "urdir" remete igualmente às ações de tramar, enredar, maquinar, intrigar. Tomando como fio da meada ações de liberdade e outros tipos de procedimentos judiciários envolvendo escravos no foro de Curitiba, ao longo das últimas duas décadas do regime escravista, pretendemos compreender de que modo o "espírito do século" - metáfora dos influxos da modernização e racionalização do universo do direito no período - foi invocado e em que sujeitos históricos, processos sociais e decisões judiciais acabou por encarnar, açambarcando o "espírito da lei".Abstract: To weave means to dispose of, to organize, to sew loose threads. It is a transitive verb, as in transit was thought to be the legal culture of the second half of the nineteenth century. This paper takes as its object the construction and the circularity of this culture around a specific point: the experience - lived or desired - of freedom in the meshes of Brazilian slavery. Its central proposal is to reflect on the judicial struggles led by slaves, observing both the diversity of actors involved in them - were they proper operators of the law (curators, lawyers, magistrates, clerks) or lays (custodians, appraisers, witnesses, litigants) - , and the discourses conveyed through them (legislative, doctrinal, jurisprudential, moral, political, economic and so forth). The aim is to retrace the emergence of a national legal field deeply marked by contradictions and ambiguities, in itself a mediator between the "favors of liberty" and the "right to property", or else, on a knife edge between the rule of law and the domain of the patriarchs. Tailoring popular knowledge and scholarship, law tied the knot at the neck of many slave masters. Amid such tangled scenery of projects, perspectives and dissonant voices, it is possible to denaturalize the reified place conventionally reserved to the captives, recovering legal traditions also as part of the tradition of the oppressed. Therefore, it is necessary to abandon mechanistic readings often thrown over rights and statutes, highlighting the game of interpretations, the dispute of meanings and contents which, inch by inch, was able to shape the political-legal culture during the nineteenth century. That contributed to undermining the substantive and symbolic assumptions about captivity and ended up politicizing the courts as spaces of black resistance. In this sense, "weave" also refers to the actions of plotting, machinating and scheming. Choosing as narrative line liberty suits and other legal proceedings involving slaves in the forum of Curitiba, over the last two decades of the regime, we intend to understand how the "spirit of the age" - metaphor for the inflows of modernization and rationalization on the universe of law in the period - was invoked and in which historical subjects, social processes and judicial decisions it eventually incarnated, hoarding the "spirit of the law."436 f. : il.
