Defesa : Curitiba, 21/09/2018Inclui referências: p.218-233Área de concentração: Estado, Economia e Políticas PúblicasResumo: Buscando atualizar e aprofundar o debate marxista sobre a problemática da violação do direito em sua generalidade, a pesquisa se propõe a explorar tal objeto a partir do confrontamento em nível teórico entre duas correntes de pensamento delimitadas: a crítica marxista ao direito e a análise econômica do direito (AED). No âmbito das relações de produção, apreendem-se sistêmicas relações de violação do direito por parte de um grande número de unidades produtivas, em grande medida como estratégia de minimizar custos com obrigações ou transgredir obstáculos legais. Neste sentido, a sistemática de relações de violação do direito pode ser considerada um problema real, cotidiano e que afeta principalmente a vida das populações historicamente exploradas e as suas lutas por melhores condições sociais. Delimita-se, a partir disso, a investigação da violação do direito e sua misteriosa relação com a dinâmica mercantil da sociedade capitalista. Analisa-se criticamente a construção da assim chamada "teoria da violação eficiente do direito" no campo da AED, tendo por centralidade o exame das obras de Coase, Birmingham e Posner. A partir de uma inspiração no exercício antropológico do estranhamento, esta teoria é observada como um objeto exótico transformado em familiar, buscando-se compreender de que modo o fenômeno da violação do direito é por ela abstratamente representado. Em síntese, os resultados desta análise indicam que o campo da AED formalizou teoricamente, a partir da década de 1970, abstrações de objetivações materiais da violação do direito e, como expressão de sua característica sinceridade burguesa, apresentou elementos que permitem a produção de aproximações na investigação deste fenômeno. Combinando tais acúmulos com a interpretação da obra Teoria Geral do Direito e Marxismo, de Evguiéni Pachukanis, torna-se possível afirmar que o movimento real das relações de violação do direito está no encontro entre sujeitos de direito em relações decorrentes condicionadas pela forma da troca de equivalentes. A problemática da pesquisa, a partir disto, coloca-se do seguinte modo: a categoria violação do direito representa uma forma geral (variante particular de circulação), abrangendo unitariamente um fato (ação arbitrária de uma das partes) e uma relação decorrente (relação de troca-contratual estabelecida após o fato). Com esta aproximação, discute-se ainda a possibilidade de reunião de pelo menos três grandes conjuntos de relações sociais particulares que assumem esta forma geral: (i) violações de contratos, (ii) violações de normas legais e (iii) violações de direitos subjetivos. Em todas elas, o centro explicativo do fenômeno é encontrado justamente na possibilidade de pagar uma medida equivalente ao direito violado. É o ato do pagamento, como momento de realização da equivalência entre o fato de violação do direito e a pretensão jurídica concreta correspondente, que confere sentido material para a noção jurídica de sanção em seu sentido mais geral - abrangendo, por exemplo, desde o caso do homicídio até o caso da violação contratual. A estranha forma da violação do direito apresenta-se, assim, como complemento à forma jurídica na dinâmica das relações de produção: enquanto esta representa a via histórica de mercantilização da vida, aquela representa a via histórica de sua calculabilidade. Crítica à análise econômica do direito.Abstract: In order to update and to deepen the Marxist debate on the problem of the violation of the law in its generality, the research proposes to explore this object from the confrontation at a theoretical level between two delimited currents of thought: Marxist Critique of Law and Law & Economics. In the context of production relations, systemic breach of the law by a large number of productive units is perceived, largely as a strategy to minimize costs with obligations or to transgress legal obstacles. In this sense, the system of relationships of violation of the law can be considered a real and daily problem, that affects mainly the life of the historically exploited populations and their struggles for better social conditions. From this, it can be delimited the investigation of the violation of the law and its mysterious relationship with the mercantile dynamics of capitalist society. The construction of the socalled "efficient breach theory" in the field of Law & Economics is critically analyzed, with a focus on the works of Coase, Birmingham and Posner. From an inspiration in the anthropological exercise of estrangement, this theory is observed as an exotic object transformed into familiar, seeking to understand how the violation of the law phenomenon is abstractly represented by it. In summary, the results of this analysis indicate that the Law & Economics field theoretically formalized, from the 1970s, abstractions of material objectifications of the violation of the law and, as an expression of its characteristic bourgeois sincerity, presented elements that allow the production of approximations in research of this phenomenon. Combining such accumulations with the interpretation of Evguiéni Pachukanis's General Theory of Law and Marxism, it's possible to affirm that the real movement of the violation of rights relations is in the encounter between subjects of law in relations conditioned by the form of the equivalents exchange. The problem of research, from this, is as follows: the category of violation of law represents a general form (a particular variant of circulation), unitarily covering a fact (arbitrary action of one of the parties) and a resulting relation of exchange-contract established after the fact). From this approach, it's also discussed the possibility of gathering at least three large sets of particular social relationships that take this general form: (i) violations of contracts, (ii) violations of legal norms and (iii) violations of subjective rights. In all of them, the explanatory center of the phenomenon is found precisely in the possibility of paying a measure equivalent to the violated right. It is the act of payment, as a moment of realizing the equivalence between the violation of the law and the corresponding concrete legal claim, which gives material meaning to the legal notion of sanction in its most general sense - covering, for example, from the case from homicide to breach of contract. The strange form of the violation of law thus appears as a complement to the juridical form in the dynamics of the relations of production: while this represents the historical path of commodification of life, it represents the historical path of its calculability.
