Defesa: 11/02/2003Inclui referências: p. 187-196Resumo: A presente tese defende a reconstrução da noção de subordinação jurídica como critério distintivo do contrato de trabalho. A partir de uma reconstrução histórica da noção no direito do trabalho, a tese demonstra que, na nova organização produtiva de padrão pós-fordista, que rompeu com a hegemonia do taylorismo-fordista, a subordinação sofreu grande perda de operacionalidade como critério para o direito do trabalho. O diagnóstico da fragmentação da relação salarial é fator determinante que produziu a crise da noção de subordinação jurídica, com enorme impacto sobre o âmbito de aplicação do contrato de trabalho. A partir da categoria do trabalho imaterial, essa fragmentação é compreendida como um processo que provocou a difusão da subordinação no tempo e no espaço da produção e, assim, deu origem às novas formas de subordinação. A formulação apresentada defende o resgate histórico da noção pela justificação sócio-econômica de proteção ao trabalho dependente, permitindo que sejam amparadas pelo direito do trabalho diversas atividades de trabalho pessoal e por conta de outrem. No direito do trabalho brasileiro, a prevalência da noção de subordinação jurídica, nessa perspectiva, deve comportar uma nova compreensão que reoriente o processo legislativo e a prática jurisprudencial.Abstract: The present thesis defends the reconstruction of the juridical subornation notion as a distinctive criterion of the labor contract. From a historical reconstruction of the notion in the labor law, the thesis shows that, in the new productive organization of pós-fordista pattern, which broke with the hegemony of the taylorismo-fordista, the subordination suffered great loss of operational capacity as a criterion for the labor law. The diagnosis of the wage relationship fragmentation is the decisive factor which produced the crisis of the juridical subordination notion, with a huge impact on the ambit of application of the labor contract. From the category of immaterial labor, this fragmentation is understood as being a process which provoked the diffusion of the subordination in the production time and space and, in this way, it originated the new ways of subordination. The definition presented herein deffends the historical rescue of the notion through the social-economical justification of protection given to dependent labor, allowing several activities of personal labor, as well as the ones done by others to be supported by the labor law.
