Partindo do pressuposto de que, os instrumentos de repressão e coerção têm se mostrado insuficientes para a proteção dos bens ambientais, apresenta-se uma análise do comportamento do setor florestal paranaense em função da legislação florestal e ambiental vigente, tendo a Região das Florestas de Araucária como base produtora. Percebe-se que uma eficiência maior pode ser conseguida mediante a agregação de novos instrumentos legais e de política, como a criação de novos espaços naturais protegidos, incentivos fiscais e a criação de linhas especiais de crédito. Um grande desafio se estabelece, e é nesse sentido que a tese é desenvolvida a partir do Capítulo 3, na busca da criação de um programa de gestão florestal, que vislumbre a conservação e a recuperação dos remanescentes florestais de Araucária no Estado, sem onerar de forma excessiva a região de influência, nem refrear o crescimento econômico do setor agroflorestal regional. O uso controlado dos recursos madeireiros e não madeireiros nas unidades de conservação de uso sustentável possibilita a autogestão dos espaços naturais protegidos, o controle dos estoques de madeira na região e, conseqüentemente, diminui a pressão sobre os remanescentes florestais locais. Ainda, a criação de uma nova categoria de Unidade de Conservação, a Reserva Particular de Desenvolvimento Sustentável, dá ao proprietário rural a alternativa de aferir lucro de suas florestas e, concomitantemente, proporcionar a comunidade o aumento das áreas protegidas no Bioma Florestal com Araucária. Outra medida que se mostra viável é a criação de dispositivos fiscais (tributários) para o incentivo à conservação do meio ambiente. As espécies tributárias escolhidas para este trabalho foram o imposto sobre Transmissão de Bens imóveis (ÎTBi) e o imposto sobre Produtos industrializados (iPi). Após a análise dos dados conclui-se que ambas alternativas são viáveis, eis que incentivam a conservação das áreas florestais, possibilitam ao proprietário rural uma renda alternativa, geram renda e empregos para a região e, finalmente, não oneram o Erário. Portanto, o caminho para a preservação do Bioma está realmente em políticas que busquem a harmonização entre um meio ambiente equilibrado e uma sociedade mais justa.Abstract: The present study deals with the deforestation process of natural forests in the State of Parana, the evolution of the agrarian cover, and the social and economic situation of the Araucaria forests statewide, since its settlement process, covering the great economic cycles, until the present time. Assuming that the instruments of repression and coercion have been insufficient for the protection of the environmental assets, an analysis of the behavior of the Parana's forest sector as result of the forest and environmental legislation is presented, having the region of the Araucaria forests as the producing base. It is perceived that a higher efficiency can be achieved by aggregating new legal and policy instruments, such as the creation of new natural protected areas, tax incentives, and special lines of credit. A great challenge is established, and the dissertation is developed in this direction from Chapter 3, in the search for the creation of a forest management program, that has glimpsed the conservation and recovery of the Araucaria forest remains in the State, without extremely burdening the influence region, or refraining the economic growth of the regional agricultural sector. The controlled use of the lumber and non-lumber resources in the Conservation Units of Sustainable Use makes possible the self-management of natural areas, the control of wooden endowments in the region, therefore, decreasing the pressure over the local forest remains. Still, the creation of a new category of Conservation Unit, the Private Reserve of Sustainable Development, gives to the agricultural owner the alternative to attain profits from his forests and, at the same time, provides the increase of protected areas in the Araucaria Forest Ecosystem to the community. Another measure that has proved viable is the creation of fiscal mechanisms (taxes) for the incentive of the environmental conservation. The taxes chosen in this study were the ITBI (Real StateTaxes) and the IPI (Industrial Taxes). The analysis of the data indicated that both alternatives would be viable by stimulating conservation of forest areas, by making possible an alternative income to the farmers, by generating regional income and jobs, and finally, by not burdening the State Treasury.
